ORDINANCE NO. 9-59 BY: <br /> <br />Messrs. Gottermeyer, Law, her, <br /> Ward, Checkley, <br /> Fahrenbach, Fairgrieve, <br /> Gaydos. <br /> <br /> AN EMERGENCY ORDINANCE amthorizing settlement of the ~laim of <br />Gladys Stanton, in the total amount of one thomsand dollars, arising <br />out of a fall into a manhole at the corner of Brockley and Clifton <br />Bomlevard, on December 6, 1958. <br /> <br /> ~EREAS~ This ordinanceconstitutes aa emergency in that it may <br />save the city from further expens~ and possible litigation in that it <br />provides for the immediate settlement of said claim, and in that it <br />provides for the usual operation of a municipal department, now, there- <br />fore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKE~OD, STATE OF <br />OHIO: <br /> <br /> Section 1. That settlement of the claim ef Gladys StaRteR in <br />the amount of one thousand dollars is hereby ordered and authorized,~. <br />conditioned upon the execution and delivery by Gladys Stamton of a <br />full release in favor of the City of Lakewood, duly approved by the <br />Director of Law. <br /> <br /> SectieR 2. That the Director of FiRance be and he is hereby <br />authorized to pay the sum of ere thousaRd dollars to Gladys StaRteR, <br />upon delivery to the Director of FiRaRce of the foregoing release <br />duly executed and approved; aRd to charge the same to the GeReral <br />Fund - Damages Paid by the City. <br /> <br /> Section 3. That this ordinance is hereby declared to be aR <br />emergency measmre for the reasons stated iR the preamble hereof aRd <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be iR force immediately <br />upoR its adoption and approval by the N~yor. <br /> <br />Adopted:.
