<br />"" <br /> <br />Any øfficer or person in ~arge, or the majority where there <br />are more than one, of any office, court, commission, board, <br />institution, department or agency of the City, may req~est, <br />in writing, that permission be granted to destroy or other- <br />wise dispose of records, papers or instruments that are not <br />specifically required by law to be kept, witho~t being <br />copied or reprod~eed as preseribed in Seetion 9.01 of the <br />Revised Code, and which do not involve any title to or right <br />in property or eonstitute a regular record of any court, if <br />suc~ records, papers or instruments are more than 10 years <br />old and do not pertain to any pending case, elaim or action <br />and no longer have any value, historical or otherwise. When <br />any such application is made by a member of the eommissiøn. <br />that member shall not serve in the eonsideration of that <br />application. <br /> <br />- <br /> <br />:2 <br /> <br />- <br /> <br />~ <br /> <br />, <br /> <br />No order of the commission to destroy ør otherwise dispose <br />øf any records mentiøned in this seetion, shall be valid <br />unless it is agreed to by each s~ch member of the commission <br />eligilDle to act under this section, reduced to written form <br />and signed by eaeh member. <br /> <br />Seetian 4. That Sectiøn 13s.e4 of the Administrative Code <br />øf the Codified Ordinances of the Oity of Lakewood be enacted tø <br />read as fellows: <br /> <br />138.04 Resol~tion necessary to destroy or dispose of records. <br /> <br />If the ~ity Records Commission deems it advisable tø destroy <br />or dispose of the records mentioned in this ~apter, it <br />shall adopt a resol~tion setting forth what records are to <br />be destroyed or disposed of. <br /> <br />Seetion 5. That Section 138.05 of the Administrative Code <br />of the Codified Ordinances of the City of Lakewood IDe enacted to <br />read as follows: <br /> <br />138.05 Destruction or disposition without compliance pro.. <br />hibited. <br /> <br />No person having. the e~stody of any records shall destroy <br />or dispose of them, or procure or permit the destruction or <br />other dispostion of them without complying with this section. <br /> <br />Section 6. That Seetion 13$.99 of the Administrative Code of <br />the Codified Qrdinances of the City øf Lakewoød be enacted to read <br />as follows: <br /> <br />shall be fined <br /> <br />13$.99 Penalty. <br /> <br />Whoever violates Section 13$.05 of this ~apter <br />not less than $50.0@ or more than t3ØØ.OØ. <br /> <br />Section 7.
