The second party further agrees fully and promptly to <br />reimburse the City of ~akewood, or the Firemen's Relief <br />and Pension Fund, as the case may be, for any pension or <br />indemnity or premi~ contribution assessed against the City <br />of Lakewood for Workmen's Compensation benefits for injur- <br />ies or death of members.of the Division of Fire occurring <br />while engaged in rendering service under this agreement. <br /> <br />5. This agreement shall in no event be held or construed <br />as conferring a right of action for damages on any property <br />owner Or any other person, firm or corporation for the <br />operation or failuEe to operate hereunder. <br /> <br />6. Second party agrees to furnish like apparatus and <br />service to the City of Lakewood under the same terms and <br />conditions hereinabove applicable to the furnishing of <br />such apparatus and service to second party by the City of <br />Lakewood. <br /> <br />7. This agreement shall be in force and effect for a period <br />of thr$e years beginning January l, 1960 and ending December <br />31, 1962~ unless terminated during such period by either <br />party, in the manner hereinafter provided. Either party <br />hereto may terminate this agreement at any time during <br />such period, by giving written notice to the other party <br />of such intention to terminate, at least sixty days prior <br />to the date which shall be stated in such notice as the <br />date of termination. <br /> <br /> IN ~ITNESS ~HEREOF, the parties hereto have set their hands <br /> as of the date first above written.~i <br /> <br />Section 2. That the officers authoriZed to request the <br />City of Fairview Park to furnish the apparatus and service <br />as provided in the said agreement are hereby designated to be: <br />the Mayor, Acting ~yor, the Chief of the Division of Fire, and the <br />Assistant Chiefs of the Division of Fire. <br /> <br /> Section 3. That this ordinance is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof, <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by t~e Mayor; and all <br />ordinances or parts of ordinances inconsistent herewith are hereby <br />repealed. <br /> <br />Adopted: <br /> <br />Decemb,er 7, 1~59 <br /> <br />Thomas C.
