ORDINANCE to levy special assessments for the improvement of <br />Garfield Avenue in the City of l.a.kewood, Ohio, between certain termini by the <br />necessary grading of the base, resurfacing with asphaltic concrete including <br />t.he necessary replacement and resetting of castings and resetting and replacing <br />the curbs together with the necessary appurtenances thereto. <br /> <br />WEEREAS, this Council by two-thirds vote of the members elected thereto <br />determines that this ordinance is an emergency measure which is necessary for <br />the immediate preservation of the public peace, property, health and safety and <br />for the further reason that the assessments herein provided for must be promptly <br />levied in order to retire outstanding notes by the issuance of bonds and there- <br />by preserve the credit of the City. <br /> <br />Lakewood, <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Cuyahoga County, State of Ohio: <br /> <br />Sect:i,on 1. That the assessment of the cost and expense of improv:i,ng <br />Garfield Avenue from Brmm Road to Harren Road in the City of Lakewood, <br />Ohio, by the necessary grading of the base, resurfacinG ~~ith asphaltic concrete <br />including the necessary replacement and resetting of castings and resetting and <br />replacing the curbs together with the necessary appurtenances thereto as set <br />forth in Resolution No. 4313 adopted by this Council on February 17, 1964 <br />and amounting in the aggTegate to $5,968.09 as reported to this Council <br />on '~he 5th day of February, 19'05, by the Director of Finance, be and the same is <br />hereby adopted and confirmed, and that there be and are hereby levied and <br />assesSèd upon the lots and lands boundi.ng and abutti.ng upon said improvement the <br />several a¡nounts reported as aforesaid, ~1hich assessments and the description of <br />said lots and lands are nm1 011 file in the off:!.ce of the Clerk of Council and <br />whicD assessments are in proportion to the special benefits, and are not in <br />excess 0:" any statutpry limitatipn. <br /> <br />SectiPrl 2. That the tptal ?ssessment against each lot or parcel of land <br />shall be payable in cash not later than April 1, 1965, or at the option of the <br />QW1,er, in five annual installments with the interest at the S~4ne rate as shall <br />be borDe by the bonds to be issued in a.~ticipation of the collection of the S6.1ne. <br />All cash paJ'1nents shall be made to the Director of Finance of said City. All <br />assessments and installments thereof remaining unpaid at the expiration of said <br />period shall be certified by the Director of Finance to the County Auditor as <br />provIded by law to be placed by him on the tax duplicate and collected as other <br />taxes 'Äre collected. <br /> <br />having been determined to be an emergency <br />and effect from and immediately after its pasß~ <br /> <br />Section 3.
