AN EMERGENCY ORDINANCJ~ to levy special assessments for the improvement of Jackson Avenue in the City of Laketfood, Ohio, bet~leen certain termini by the necessary zrading of the base, resurfacing uith asphaltic concrete including the necessary replacement and resetting of castings and resetting and replacing the curbs together ~lith the necessary appurtenances thereto. HHEREAS, this Council by t'fo-thirds vote of the members elected thereto determines that this ordinance is an emere;ency measure ,fl'lich is necessary for the Ünmediate presel'V"d.tion of the public peace, property, health and safety and for the further reason that the assessments herein provided for must be promptly levied in order to retire outstanding notes by the issWtnce of bonds and there- by preserve the credit of the C:tty. ,¡OJ,¡, THEREFORE, BE IT ORDilTh1ED by the Cou.\1cil of the City of Lake~1OOd, Cuye.hoc;¡¡. County, State of Ohio: Section 1. That the assessment of the cost and expense of improving Jackson ¡",enue from Merle Avenue to C15,fton Boulevard in the City of Laketfood, Ohio, b~r the necessary grading of the base, resurfacing 'fith asphaltic concrete including the necessary replacement and resetting of castings and resettine; and repJßcing the curbs together with the necessary. appurtenances thereto as set fortb in Resolution l~o. 4316 adopted by this Council on February 17, 1964 and amounting in the aggregate to $5,171.58 as reported to this Council on the 5th fu-W of February, 19b5, by the Director of Finance, be and the same ls hereby adopted and con:firmed, and that there be and are hereby levied and assessed upon the lots and lands bounding and abutt1ng upon said improvement the several amounts reported as a:foresa1d, 'fhich assessments and the description ot' said lots and lands are nrnf on file in the office of the Clerlt of Council and ,~hich D.ssessments are in proportion to t:1e spec1al benefits, and are not in excess of "-~ statutory limltation. Section 2. That the total assessment against each lot or parcel of land shaH be payable in cash not later than April 1, 1965, or at the option of the almer, in -five annual installments with the interest at t1',e same rate as shall be borne by the bonds to ,be issued in anticipation of the collection of the same. All cash pa;yments shall be made to the Director of Finance of said City. All assessments and installments thereof' remaining U-Ylpaid at the expiration of said period shall be certlned by the Director of Finance to the County Auditor as provlded by la'f to be placed by him on the tax duplicate and collected as other taxes are collected. Section 3. This ordinance, having been determined to be an emergency mee,sure, shall be in full force and effect from· and :!JrJmedlately after its pass- age and approval by the l'Jayor.
