AN E~ZqGENCY ORDINANCE determining to proceed with the improvement of Gl~d~s Avenue in the City of Lakewood, Ohio, by the necessary grading of the base, resurfacing with asphaltic concrete includXng the necessary replacement and resetting of castings ~ud the necessary resetting and replacing of curbs together with necessary appurtenances thereto° WEEREAS~ this Council by two~third~ vote of the members elected thereto determines that this ordinmnce is an e~ergency measure which is necess~y for the immediate preservation of the public peace, property~ health and safety and for the further reason that the i~provements herein provided are L~mediately necessary to elt~i~e existing hazards to vehic~fl~r traffic u~ing the street~ of this City$ NOW~ THEREFOBE~ BE IT OBDAINED by the City of L~kewood~ C~mhog~ County~ State of Ohio~ three-fourths of all ~bers electe~ thereto concurring: Section 1o That it is hereby deter~lne~ to proceed with the improvement of Gladfffs Avenue frem Detroit ~venue to Cli~ton Avenue. Section 2. S~ch £~l~rovement shall be m~de by the necessary grading of the base~ r~s~Tacing with asphaltic concrete including the necessary replacement setting of casting~ ~d the necessary resetting and reDUcing of curbs together with necessary ap~enar~ce~ thereto ~nd in accordance with Resolution Nco 4J~07 passed en T~e 15th day of M~rch, 1965~ and in accordmuee with the plans, specific~tions eetim~tes and profiles heretofore approved and now on file i~ the office of th~ Director of Publi~ Work~ the character of the materials to be bid upon for the resurfacing is' ~sphaltic concrete and for the curbs is stone or concrete as shown on the plans~ and reference is made to said plans and specifications for additional information concerning the character of the materials for ~uch i~provement Section 3. That the Bo~rd of Revision of Assessments has reporb~ed to this Council that no c~ for ~ge~ ~s~ting fr~ the ~r~t ~ve been filed~ b~t if it sho~ be ~e~ined t~t ~ c~ ~ve be~ filed~ they ~ha~ be in~ ~i~a into before the c~enc~ent of the proposed ~r~nt, ~d the Director of ~w $~ be~ ~d he i~ hereby authorize~ ~ ~ed to institute le~ ~rocee~ngs in ~ c~ ~ c~etent Jurisdiction to inq~re inte ~ e~ ~o filed. ~ection 4. That net more than 50% of the whole cost of said improvement shall be assessed by the 'b~nefits upon the following described~ lots and land~ to wit: All lots and l~nd~ bounding and abutting upon the proposed i~provement between the termini aforesaid, which said lots and lands are hereby determined to be specially Benefited by said i~prove~ent~ and the cost of said ~rovement shall include the cost of prelimix~ry and other sturveys, plans, ~pecifications, profiles ~nd estimates and of printing, serving ~ud publishing notices~ resolu- tions and ordina_uces~ the ~mouut of damages resulting frc~a the i~provement assessed in f~vor of s~4v o~ner of l~ud affected by the improv~nt a~d the in~ terest thereon~ the co~bs incurred in cc~.ection ~ith the prel~ration~ levy and collection of the special assesam~nts, the ce~% of ~rch~si~ug~ appropriating,
