AN EMERgeNCY ORDINANCE determining to proceed with the improvement of Iakewo~d Avenue in the City of Lakewood, Ohio, by the necessary g~ of the base, resurfacing with asph~ltic concrete including the necessary replacement end resetting of castings end the necessary resetting and replacing of curbs together with necessary appurtenances thereto. WNEBEAS~ this Couucil by two-thirds vote of the members elected thereto determines that this ordtn~uce is e~u emergency measure which is necessary for the ~mediate preservati~u of the public peace, property, health end safety and for the further re,son that the improvements herein provided are immediately necessary to eliminate existing hazards to vehicular traffic using the streets of this City; NOW~ THEREFOBE~ BE IT ORDAINED by the City of Iakewood, OuTahogm County, State of Ohio, three-fourths of edl members elected thereto concurring: Section 1. That it is hereby determined to proceed with the improvement of Lakewood Avenue from Detroit Avenue to ~ltson Avenue. Section 2. Such improvement shall be made by the necessax-y growling of the resurfacing with asphaltic concrete including the necessary replacement and setting of castings and the necessary resetting and replacing~ of curbs together with necessary apl~enances thereto end in accordance with Resolution No. 4408 passed on the 15th day of ~rch, 1965, and in accordance with the plans, specifications estimates end profiles heretofore approved and now on file in the office of the Director of Public Works~ the character of the m~terials to be bid upon for the resurfacing ia asphaltic concrete end for the curbs is stone or concrete as shown on the plens, and re~erence is made to said plans and specifications for additional information concerning the char~oter of the mmterials for such improvement. Section 3. That the Beard of Revision of Assessments has reported to this Council that no claims for damages resulting from the improve~ent have been filed~ but if it should be determined that am~ claim~ have been filed, they shall be ~uired into before the commencement of the proposed improvement, and the Director of Law shall be, and he is hereby authorized and directed to institute legal proceedings in a court of competent j-~risdiction to inquire into any claims so filed. Section 4. That not ~re than 50% of the whole cost of said improvement shall be assessed by the benefits upon the following described lots end land~, to wit: Ail lots and lauds bounding end abutting upon the proposed improvement between the termini aforesaid~ which said lots and lands are hereby determined to be specially benefited ~y said i~provement$ end the cost of said improvement shall include the cost of preliminary and other surveys, plans, specifications, profiles and estimaeS and of printing, serving and pablishing notices, resolu- tions and ordL~auces~ the amount ef ~emages reaulting fr~ the improvement assessed in favor of ar~ owner of l~ud m~fecte~ by the i~provement and the in~ terest thereen~ the costs incurred in connexion ¥ith the preparation, levy end collection of the ~pe¢ial as~e~ment~ t?~ cost of p~rc~ing~ approprimting~
