ORDINANCE NO~ 4~~65 BT: Messrs. Wendling, Bennett, Cain, Gaydos, Usher, Ward. AN EMER(F~NCY ORDINANCE determining to proceed with the im~provement of Olivewood A~enue in the City of I~k~ood, Ohio, by the necessary grading of the base, resurfacing with asphaltic concrete including the necessary replacement and resetting of castings anC the necessary resetting ~ud replacing of curbs together with necessary appmrtenauces thereto° WHE~ this Council by two~thirds vote of the members ~lected thereto determines that this or~trmace is au emergency measure which is necessary for the la~ediate preservation of the public peace, property, health and safety and for the i~rther reasc~ that the ~zprovements herein provided are ~diate/y necessary to eliminate existing hazards to vehic~3~ar traffic using the streets of this City~ NOW~ THEREFORE~ BE IT ORDAINED by the City of Lak~ood, C~y~hoga Co~auty, State of Ohio~ three-fourths of all members elected thereto concurring: Section 1o That it ~is hereby ~termined to proceed with the improvement of Oliv~wood Avenue fror~ Detroit Aven~m to Ced~rwoed Avenue° Section ~o Such improvement shell be m~de by the necessary grading of the base~ remurfacing with asphaltic concrete including the necessary replacement and re~ setting of ca~ting~ mad the neceesary resetting and replacing of curbs together with necessary aplmzrten~uces thereto and in accordance with Resolution No~ 4~O9 passed on th~ 15th ~ of March, 1965, and in accordance with the plans~ speeification~ eeti~tes and profiles heretofore ~oproved aud now on file in the office of the Director of P~blic Works~ the character of the m~terials to be bid u~ou for the resurfacing is' asphaltic concrete and for the curbs is stone or concrete ~ shown on the plans, and referenc~ is made %o said plans ~ud specifications for additior~l i~form~tion concerning the character of the materials for such improvement. Section 3o ~That ihs B~rd of Revision of A~mess~ents has reported to Codicil that no cla~ for ~ges red.ting fr~ the ~rov~eD~ ~ve been filed~ but if it sho~d be ~%e~ned t~t ~ c~ ~ve been filed~ they s~ quired ~to before the c~c~ent of the pro~sed ~rov~nt~ aud the Director of ~w ~1 be~ ~d he is here~ authorized ~d ~rected to institute le~ procee~nge ~ a c~ of c~etent ~is~ion to inquir~ into ~ c~s so filed~ Section 4. That not more than 50% of the whole cost of said i~rovement shell be assemsed by the benefits upon the following described lots aud l~uds~ to wit: All lots and lands bounding aud abutting upon the proposed improvement between the termini aforesaid, which said lots and lauds are he~?by determined to be specially benefite~ by ~aid lmprovement~ and the cost of said improvement shall include the cost of preliminary and other sur~eys~ plans~ specifications, profiles and esti~%tes and of printing~ serving and publishing notices, resolu- tlons s. ad ordinances~ the ~mouut of damages resulting from the improvement assessed in favor of a~y ow~sr of land ~ffected by the impro~m~nt and the in- terest thereon~ 'the costs incurred in conuection with the prepars£ion~ levy and collection of the s~ecial ~sessme~ts, the cost of p'~rch~sing~ ~ppropriating,
