-2- <br /> <br />(3) The MUNICIPALITY, upon or prior to the taking effect <br />of this agreement, will pay into the County Treasury to <br />the credit of a special fund established and known as the <br />'~Police Teletype County System Fund" the sum of Six <br />Hundred Dollars ($600°00), which is estLmated to pay for <br />the service and maintenance charges of the equipment and <br />instruments installed for the MUNICIPALITY for a period of <br />one (1) year from June 1, 1965, to June 1, 1966. <br /> <br />Further~ the MUNICIPALITY will, on or before the 1st day <br />of June in each of the years 1966 and thereafter, make a <br />payment of Six Hundred Dollars ($600.00) into the County <br />Treasury for similar purposes. The COMMISSIOb~RS will <br />pay such service and maintenance charges for the equip- <br />ment and instruments installed for the MUNICIPALITY, and <br />will, within a reasonable time after June 1st in each <br />year covered by this agreement, account to the MUNICIPALITY <br />for the actual payments made by the COMMISSIONERS in the <br />MUNICIPALITY'S behalf° Any surplus shown by such account- <br />ing shall promptly be returned to the MUNICIPALITY by the <br />CO~.~ISSIONERS or, at the election of the MUNICIPALITY, <br />credited to the next annual pa~ent, if any, due from the <br />MUNICIPALITY. The COMMISSIONERS, from County funds, have <br />paid and will continue to pay the cost of installation, <br />service, and maintenance of the equipment and instruments <br />to the office of the Sheriff. <br /> <br />(4) This agreement shall become effective as of June 1, <br />1965, only on condition that it has been duly authorized <br />and executed in behalf of each party hereto, and that the <br />payment to be made by the MUNICIPALITY has been made, and <br />also that similar agreements have been duly authorized and <br />executed and payments thereunder made on behalf of at <br />least ten (10) municipalities in Cuyahoga County, Ohio. <br />Similar agreements may also be made and services rendered <br />thereunder between the COMMISSIONERS and any municipali- <br />ties in Cuyaboga County or adjoining counties. <br /> <br />This agreement shall be in force from June 1, 1965, and <br />shall continue in full force and effect thereafter, unless <br />terminated by either party upon sixty (60) days written <br />notice to the other party of an intention to terminate, and <br />provided further that this agreement may be rescinded by <br />the COMMISSIONERS on similar notice at any time when <br />similar agreements are not in effect between the COMMISS- <br />IONERS and at least ten (10) municipalities in Cuyahoga <br />County, Ohio, or if the COMMISSIONERS will be unable to <br />continue the service and maintenance of the equipment and <br />instruments of the Ohio Bell Telephone Company for said <br />teletype system and service between the office of the <br />Sheriff and the MUNICIPALITY. <br /> <br />In case of such rescission, the COMMISSIONERS shall prompt- <br />ly account for and pay over to the MUNICIPALITY any monies <br />paid by the MUNICIPALITY under this agreement and not <br />expended thereunder in behalf of the MUNICIPALITY° <br /> <br /> <br />
