WendliDg, Bennett, <br /> ORDINANCE NO. 62-65 BY: Gaydos, Huffman, <br /> Usher, Ward. <br /> AN EF~ERGE~'$Cy ORDINANCE authorizing the Mayor, .on behalf <br />of the City of Lakewood, to purchase the certain real estate <br />located at 1456 Marlowe Avenue, in the City of Lakewood, here- <br />inafter more particularly described. <br /> <br /> WHEREAS, This ordinance constitutes an emergency meas- <br />ure in that the owners have agreed to sell said property for <br />the consideration hereinafter stipulated which this Council <br />~eems to be in the best interest of the City and in that it <br />provides for the public health and welfare and for the usual <br />daily operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAI~IED BY TP/E COUNCIL OF THE CITY OF LAKEWOOD, <br />STA'/~ OF O~io: <br /> <br /> Section 1o That the Mayor be, and he is hereby author- <br />ized to purchase from Elizabeth D0 Root and from the Executrix <br />of the Estate of Dorothy Co Hoffner, the following described <br />property,together with Release of Dower, if any. <br /> <br /> "Situated in the City of Lakewood, County of Cuya- <br /> hoga, and State of Ohio, and known as being the <br /> Northerly 39 feet of the Southerly 40 feet of <br /> Sub Lot No. 233 in The Genck Realty Company's <br /> Subdivision of a part of Original Township Section <br /> MOo 22 as shown by the recorded plat of said <br /> Subdivision in Volume 35 of Maps, Page 26 of Cuyahoga <br /> County Records. <br /> <br /> Said part of said Sub Lot No. 233 has a frontage of <br /> 39 feet on the Westerly side of Marlowe Avenue, and <br /> extends back between parallel lines 119 015/1000 feet <br /> on the Northerly line, 119 605/1000 feet on the <br /> Southerly line, and has a rear line of about 39 <br /> 01/100 feet, as appears by said plat, be the same <br /> more or less, but subject to all legal hi~:wayso" <br /> <br />and to pay therefor the sum of Twenty-Five Thousand Dollars <br />($2 5, 000.00) ° <br /> <br /> Section 2o That the title to said property shall be <br />subject to the approval of the Director of Law; that taxes <br />and assessments shall be pro-rated as of the date of transfer; <br />that the Director of Finance be, and he is hereby authorized <br />to pay the amount set forth in Section 1 hereof from the Hos- <br />pital Capital Outlay and Depreciation Fund upon delivery by <br />the Grantors of the Warranty Deed and the Executor's Deed, to- <br />gether with Release of Dower, if any, tot he City of Lakewood, <br />together with Guaranty of Title disclosing the said real estate <br />to be free and clear of all encumbrances, excepting taxes and <br />assessments not yet due and payable, zoning ordinances and re- <br /> trlctlons of record, if any;and that the Director of FinanceA~ <br /> <br /> <br />
