-2- <br /> <br />actions, damages, costs, charges and expenses of every <br />kind made, suffered or incurred in any manner by <br />negligence or carelessness in its operation and shall <br />save the CITY and its inhabitants harmless from all <br />claims and demands by itself, its employees or any other <br />person, firm or corporation arising out of or in con- <br />nection with the collection, transportation and disposal <br />of refuse° <br /> <br />5° The COMPANY shai1 file with the CITY a certificate <br />of insurance of an insurance .company satisfactory to the <br />CITY certifying that the CITY is included as an insured <br />under motor vehicle bodily injury and property damage <br />insurance covering each motor vehicle used in the per- <br />fo~mance of this agreement in an amount not less than One <br />Hundred Thousand Dollars ($100,000.00) on account of injury <br />or death of any one (t) person and in an amount of not <br />less than Three Hundred Thousand Dollars ($300,000.00) <br />on account of the injury Or death of two (2) or more <br />persons and in an amount not less than Twenty-Five Thousand <br />Dollars ($25,000o00) for each accident resulting in property <br />damage, said certificate to recite that ten (10) days' <br />notice shall be given by the insurer in writing to the <br />CITY prior to cancellation of such insurance° <br /> <br />6. The COMPANY agrees that each truck used by it in the <br />performance of this agreement shall have prominently <br />displayed thereon the name of the COMPANY° <br /> <br />7o The COMPANY agrees that ail containers and/or vehicles. <br />used by them shall be water tight and shall be provided <br />with a canvas cover and so operated as to prevent refuse <br />from being blown, dropped or spilled. <br /> <br />8. All such refuse and rubbish shall be disposed of by <br />the COMPANY at the COMPANY'S sole expense~ <br /> <br />9o The CITY hereby agrees to pay to the COMPANY the sum of <br />Ninety-Five Cents (.95¢) per cubic yard for any and all <br />such refuse and rubbish accepted and disposed of by the <br />COMPANY. Invoice shall be rendered by the COMPANY monthly <br />for the preceding month and the CITY shall make payment <br />promptly upon receipt thereof° <br /> <br />10o The CITY shall be responsible for delivering all such <br />refuse and rubbish to the COMPANY'S containers and deposit- <br />ing it therein. <br /> <br />11o The invitation to bid, general conditions, specifica- <br />tions, bid proposal and this contract shall be considered <br />as one instrument and as constituting the contract between <br />the parties. <br /> <br />12. This contract shall become effective immediately upon <br />the execution thereof by both parties and shall be <br /> <br /> <br />
