ORDINANCE NO. 73-65 BY: Messrs. Ward, Wendling, Bennett, Cain, Gaydos, Huffman, Usher. MN E~ERGE~CY ORDINANCE approving certain Change Order in connection with the Contract for the construction of Sewage Treatment Plant Improvements. WHEREAS, Council has heretofore authorized the Director of Public works to enter into an Agreement with Mosser Construction, Inco, for the construction of Sewage Treatment Improvements, and, WHEP~AS, Under the terms of such Agreement, changes become necessary, and, WHEREAS, The Council desires to take advantage of cer- tain changes in Construction Agreement, and, WHEREAS, The completion of the Sewage Treatment Plant Improvements is desirable at the earliest possible time, and, ~REASa The adoption of this ordinance at the earliest possible time is necessary for the preservation of the Public peace, property, health or safety and that it provides for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1o That the items described in Bulletin No. 2 prepared by Woodruff and Associates, Consultants, be added to the Contract hereinbefore entered into by the City with the Mosser Construction~ Inco, with reference to the construction of the Sewage Treatment Plant Improvements, Lakewood, Ohio, and that the net cost of the Change Order contained in said Bulletin No. 2 is in the amount of $12,134.95; that said additions and changes to construction have been generally referred to as coordinating the installation and operation of various equipment units; providing for contingency items encountered during construction period; providing facilities for the convenience and safety of plant personnel. Section 2. That the Director of Public Works is hereby authorized and directed to approve said Change Order. Section 3o That the net cost of such Change Order, in the amount of $12,134o95 be financed out of the proceeds of sale of the Sewage Treatment Plant Improvements Bonds. Section 4o That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two- thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
