ORDINANCE NO. 74'65 <br /> <br />BY:Messrs. Ward, Wendling, <br /> Bennett, Gaydos, <br /> Huffman, Usher. <br /> <br /> AN EMERGENCY ORDINANCE to appropriate property at <br />and known as being 1452 Marlowe Avenue, Lakewood, Ohio. <br /> <br /> WHEREAS, On the 20th day of September, 1965, the <br />Council of the City of Lakewood, Ohio, adopted Resolution <br />NOo 4438, declaring the necessity and intention of appropriat- <br />ing the land hereinafter described, notice of the adoption <br />of which resolution has been served on the owners, persons <br />in possession or having an interest of record in said land, <br />and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the usual daily operation Of a muni- <br />cipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ~WOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the fee simple interest in and to <br />the following described real estate be and the same is hereby <br />appropriated for the purpose of constructing thereon an <br />addition to the Lakewood Hospital of Lakewood, Ohio: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga <br />and State of Ohio: and known as being Sub Lot No. 234 <br />and the Northerly 5 feet from front to rear of Sub <br />Lot No. 233 in The Genck Realty Company's "Lakewood" <br />Subdivision of part of Original Rockport Township <br />Section No. 22 as shown by the recorded plat in Volume <br />35 of Maps, Page 26 of Cuyahoga County Records, and <br />together forming a parcel of land having a frontage of <br />50 feet on the Westerly side of Marlowe Avenue and <br />extending back 118o26 feet on the Northerly line, about <br />119.01 feet on the Southerly line and having a rear <br />line of 50 feet as appears by said plat, be the same <br />more or less, but subject to all legal highways. <br /> <br /> Section 2o That the Director of Law be and he hereby <br />is authorized and directed to apply to a court of competent <br />jurisdiction to have a jury impanelled to make inquiry into <br /> and assess the compensation to be paid for the fee simple <br /> interest in said property. <br /> <br /> Section 3. That this ordinance is hereby declared <br />to be an emergency measure for the reasons set forth in the <br />preamble hereof and provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its <br />adoption and approval by the Mayor~ <br /> <br /> ~es~nt //' <br /> <br /> <br />
