ORDINANCE NO. 76-65 BY: Messrs. Bennett, Cain, <br /> Gaydos, Huffman, <br /> Usher, Ward, <br /> Wendling. <br /> AN EMERGENCY ORDINANCE authorizing settlement of the <br />claim of Jane R~theford Whitelaw, in the total amount of <br />One Thousand Three Hundred Dollars (:$1,300,00), arising <br />out of an accident when she fell on a sidewalk near 1644 <br />Warren Road in the City of Lakewood, Ohio, on September 29, <br />1962. <br /> <br /> WHEREAS, This ordinance constitutes an emergency in <br />that it may save the City from further expense and a possible <br />substantial jury verdict rendered against the City and in <br />that it provides for the usual daiiy operation cfa municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNcILoF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That settlement of the claim of Jane <br />RuthefordWhitelaw in the amount of One Thousand Three <br />Hundred Dollars ($1,300.00) is hereby ordered and authorized, <br />conditioned upon the execution and deiiverybyJane Rutheford <br />Whitelaw of a fuli release in favor of the City of Lakewood, <br />duly approved by the Director of Law. <br /> <br /> Section 2. That the Director of Finance be and he is <br />hereby authorized to pay the sum of One Thousand Three Hundred <br />Dollars ($1,300.00) to Jane RuthefordWhitelaw upon delivery <br />to the Director of Finance of the foregoing release duly <br />executed and approved; and to charge the same to the General <br />Fund - Damages paid by the City. <br /> <br /> Section 3, That this ordinance is hereby declared to be <br />an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect <br />and be in force immediately upon its adoption and approval by <br />the Mayor. <br /> <br />Adopted:...0ctober 4, 1965 <br /> John Gaydos, Jro <br /> president <br /> <br />Approved:~.0ct.o%.er 13, 1965 <br /> <br />Mary Adams <br /> Clerk <br /> <br />Robert M.
