ORDINANCE NO. 76-65 BY: Messrs. Bennett, Cain, Gaydos, Huffman, Usher, Ward, Wendling. AN EMERGENCY ORDINANCE authorizing settlement of the claim of Jane R~theford Whitelaw, in the total amount of One Thousand Three Hundred Dollars (:$1,300,00), arising out of an accident when she fell on a sidewalk near 1644 Warren Road in the City of Lakewood, Ohio, on September 29, 1962. WHEREAS, This ordinance constitutes an emergency in that it may save the City from further expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daiiy operation cfa municipal department; now, therefore, BE IT ORDAINED BY THE COUNcILoF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Jane RuthefordWhitelaw in the amount of One Thousand Three Hundred Dollars ($1,300.00) is hereby ordered and authorized, conditioned upon the execution and deiiverybyJane Rutheford Whitelaw of a fuli release in favor of the City of Lakewood, duly approved by the Director of Law. Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of One Thousand Three Hundred Dollars ($1,300.00) to Jane RuthefordWhitelaw upon delivery to the Director of Finance of the foregoing release duly executed and approved; and to charge the same to the General Fund - Damages paid by the City. Section 3, That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two- thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
