ORDINANCE NO. 85-65 BY: Messrs. Gaydos, Huffman, Usher, Ward, Wendling, Bennett, Cain. AN EMERGENCY ORDINANCE authorizing settlement of the claim of Lila Brueggemann and State Farm Mutual Automobile Insurance Company, in the total amount of One Hundred Forty- Five Dollars ($145.00), arising out of an accident which occurred on May 31, 1963, near Lewis Drive and Athens Avenue in the City of Lakewood, Ohio. WHEREAS~ This ordinance constitutes an emergency in that it may save the City from further expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daily operation of a municipal depart- ment; now, therefore, BE IT ORDAINED BY TNE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Lila Brueggemann and State Farm Mutual Automobile Insurance Company, in the amount of One Hundred Forty-Five Dollars' ($145.00), as hereby'ordered and authorized, conditioned upon the execution and delivery by Lila Brueggemann and State Farm Mutual Automobile Insurance Company of a full release in favor of the City of Lakewood, duly approved by the Director of Law. Section 2o That the Director of Finance be and he is hereby authorized to pay the sum of One H~nd~ed Forty-Five Dollars ($145.00) to Lila Brueggemann and State Farm Mutual Automobile Insurance Company upon delivery to the Director of Finance of the foregoin~ release duly executed and approved; and to charge the same to the General Fund - Damages paid by the City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
