ORDINANCE NCo 86-65 BY: Messrs. Usher, Ward, Wendling, Bennett, Cain, Gaydos, Huffman. AN EMERGENCY ORDINANCE authorizing settlement of the claim of Dorothea Cary, in the total amount of Seven Hundred and Fifty Dollars ($750o00), arising out of an accident when she fell at Warren Road and Detroit Avenue in the City of Lakewood, Ohio, on September 9, 1964o WHEREAS, This ordinance constitutes an emergency in that it may save the City from further expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daily operation of a municipal depart- ment; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Dorothea Cary in the amount of Seven Hundred and Fifty Dollars ($750°00) is hereby ordered and authorized, conditioned upon the execution and ~elivery by Dorothea Cary of a full release in favor of the City of Lakewood, duly appointed by the Director of Law° Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of Seven Hundred and Fifty Dollars ($750.00) to Dorothea Cary upon delivery to the Director of Finance of the foregoing release duly executed and approved; and to charg~ the same to the General Fund - Damages paid by City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the pre- amble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayorj!
