ORDINANCE NO. 51-66 BY: Kelley, Usher, Ward, <br /> Wendling, Gaydos <br /> <br /> AN EMERGENCY ORDINANCE enacted by the City of Lakewood, Cuyahoga <br />County, Ohio, in the matter of the hereinafter described improvement, under <br />the supervision of the Director of Highways. <br /> <br /> WHEREAS, the Director of Highways is considering improving a portion <br />of the public highway which is described as follows: <br /> <br />The improvement of State Route No. U.S. 6 Alternate, known locally <br />as Bridge Approach, by reconstructing the intersection of said <br />route with Sloane Avenue and Detroit Avenue, and by widening and <br />resurfacing the existing pavement on that portion of the designated <br />route which lies within the corporate limits of the City of Lakewood <br />between the following described termini: Beginning at a point on <br />Bridge Approach 0.04 mile, more or less, west of its intersection <br />with Sloane Avenue; thence easterly along Bridge Approach to its <br />intersection with Detroit Avenue and there terminate, being in <br />all a distance of 0.18 mile, more or less. <br /> <br /> WHEREAS, This ordinance constitutes an emergency measur9 providing <br />for the usual daily operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAREWOOD, STATE OF OHIO: <br /> <br />SECTION 1 (Consent) <br /> <br /> That it is declared to be in the public interest that the consent <br />of said City be and such consent is hereby given to the Director of Highways <br />to construct the above described improvement, in accordance with plans) speci- <br />fications and estimates as prepared by said Director. <br /> <br />SECTION II (Cooperation) <br /> <br />(a) <br /> <br />(b) <br /> <br />That said City, hereby proposes to cooperate with the State of Ohio, in <br />the cost of the above described improvement, by assuming and contributing <br />fifteen percent (15%) of the cost of said improvement, inclusive of the <br />costs of right-of-way~ engineering~ contingencies and o~her incidental <br />expenses; plus one hundred percent (100%) of the cost of rearranging and <br />adjusting municipally-owned utilities to conform with the improvement; <br />less a lump sum credit of $2,500.00 which sum represents a credit of <br />eighty-five percent (85%) of the appraised value of City-o%~ed land re- <br />quired for the construction of the improvement. <br /> <br />That said City agrees to asstune and bear initially one hundred precent <br />(100%) of the costs of the preliminary engineering report and the de- <br />tailed construction plans for the improvement, subject to the following <br />credits of such costs which are to be applied on the City's contribution <br />to the improvement: <br /> (1) Eighty-five percent (85%) of the cost of the detailed con- <br /> struction plans. <br /> (2) Eighty-five percent (85%) of the cost of the portion of the <br /> preliminary engineering report which is applicable to the City <br /> of Lakewood. <br /> (3) One hundred precent (100%) of the cost of the portion of the <br /> preliminary engineering report which is applicable to the City <br /> of Rocky River. <br /> <br />(SECTION III (Authority to Sign) <br /> <br /> That the Mayor of said City is hereby authorized to enter into <br />maintenance and parking agreements and special contractual obligations. <br /> <br /> <br />
