ORDINANCE NO, 9~67 BY: <br /> <br />Messrs. Cain, Gaydos, <br />Huffman, Kelley, Usher, <br />Ward, Wendling <br /> <br /> AN EMERGENCY ORDIb~ANCEto enact a new ordinance <br />relating to the imposition of filing fees for matters coming <br />before the City Planning Commission, the Board of Zoning Appeals <br />and the Board of Building Standards and Building Appeals and to <br />repeal Ordinance No. 4-63, adopted February 18, 1963. <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure in that it provides for the usual daily operation of a <br />municipal department; now, therefore, <br /> <br /> ~E IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1o Whenever an application concerning <br /> a particular parcel or parcels of property is made to the <br /> City Planning Commission, which Commission, in its consideration <br /> of said application, is required under the provisions of <br /> Section 1103.01 of the codified Ordinances of the City of Lake- <br /> wood~ to serve written notice of a public hearing on owners of <br /> property located within an area of 400 feet distance-from the <br /> parcel or parcels of property under coru~ideration; or, whe~ever <br /> an application is made to the Board of ZoningAppeals concerning <br /> specific cases as set forth in Section 1117.01 of the codified <br /> Ordinances of the City of Lakewood, and in which cases, as set <br /> forth in said section, the Board of Zoning Appeals is required <br /> to serve written notice of a public hearing on owners of prop- <br /> erty within 200 feet distance from the property under considera- <br /> tion, the applicant shall, at the time of making~such' applica- <br /> tion, deposit therewith~ the sum of $50.00 to pay the costs of <br />said public hearing. ' <br /> <br /> Section 2. After the making of such application <br />and deposit of the fee as set forth hereinbefore, if additional <br />hearings be required thereunder, the applicant, shall, prior to <br />the time that the notices of such additional public hearings are <br />mailed, deposit the fee in the amount of $50.00 'for each such <br />public hearing. In the event that after such fee is paid and <br />the notices for such public hearing are not sent out, and the <br />hearing is not held, said fee shall be returned to the applicant. <br /> <br /> Section 3. For all other appeals and applications <br />filed with the Board of Zoning Appeals, the appellant or appli- <br />cant, at the time of filing, shall deposit therewith the sum of <br />$10.00. <br /> <br /> Section 4. For all appeals and applications filed <br />with the Board of Building Standards and Building Appeals, the <br />appellant or applicant, at the time of filing, shall deposit <br />therewith the sum of $5.00. <br /> <br /> Section 5, This ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect <br /> <br /> <br />
