ORDINANCE NO, 9~67 BY: Messrs. Cain, Gaydos, Huffman, Kelley, Usher, Ward, Wendling AN EMERGENCY ORDIb~ANCEto enact a new ordinance relating to the imposition of filing fees for matters coming before the City Planning Commission, the Board of Zoning Appeals and the Board of Building Standards and Building Appeals and to repeal Ordinance No. 4-63, adopted February 18, 1963. WHEREAS, This ordinance constitutes an emergency measure in that it provides for the usual daily operation of a municipal department; now, therefore, ~E IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1o Whenever an application concerning a particular parcel or parcels of property is made to the City Planning Commission, which Commission, in its consideration of said application, is required under the provisions of Section 1103.01 of the codified Ordinances of the City of Lake- wood~ to serve written notice of a public hearing on owners of property located within an area of 400 feet distance-from the parcel or parcels of property under coru~ideration; or, whe~ever an application is made to the Board of ZoningAppeals concerning specific cases as set forth in Section 1117.01 of the codified Ordinances of the City of Lakewood, and in which cases, as set forth in said section, the Board of Zoning Appeals is required to serve written notice of a public hearing on owners of prop- erty within 200 feet distance from the property under considera- tion, the applicant shall, at the time of making~such' applica- tion, deposit therewith~ the sum of $50.00 to pay the costs of said public hearing. ' Section 2. After the making of such application and deposit of the fee as set forth hereinbefore, if additional hearings be required thereunder, the applicant, shall, prior to the time that the notices of such additional public hearings are mailed, deposit the fee in the amount of $50.00 'for each such public hearing. In the event that after such fee is paid and the notices for such public hearing are not sent out, and the hearing is not held, said fee shall be returned to the applicant. Section 3. For all other appeals and applications filed with the Board of Zoning Appeals, the appellant or appli- cant, at the time of filing, shall deposit therewith the sum of $10.00. Section 4. For all appeals and applications filed with the Board of Building Standards and Building Appeals, the appellant or applicant, at the time of filing, shall deposit therewith the sum of $5.00. Section 5, This ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two- thirds of all members elected to Council, it shall take effect
