Gaydos, 9uf~nmu, Kelley: <br /> Usher, Ward, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 937.05 of the <br />General Offenses Code of the Codified Ordinances of the City of <br />Lakewood relating to demolition of buildihgs and other structures° <br /> <br /> WHEREAS, This ~rdinance constitutes an emergency <br />measure providing for the public health ahd safety and for the <br />usual daily operation of a municipal department; now~ therefore, <br /> <br /> BE IT ORDAINED BY THE COLINCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That Section 937.05 of the General Offenses <br />Code of the Codified Ordinances of the City of Lakewood, now <br />reading as follows: <br /> <br />"Section 937.05 Demolition of Buildings and <br /> other structures <br /> <br />No person shall demolish or wreck any building or <br />structure by means of fire, nor shall the debris <br />from a razed building be burned within the City of <br />Lakewood, except in facilities owned and operated <br />by the City of Lakewood, notwithstanding any other <br />provision of Chapter 37 of the General Offenses Code <br />to the contrary. <br /> <br />Any person violating this section, upon conviction <br />thereof, shall be fined not more than five hundred <br />dollars ($500.00) and each day during which such <br />violation shall continue shall consti~ut~ a separate <br />offense." <br /> <br />be mn~ the m~m~ is h~rebyamended to read as follows: <br /> <br />Section 937.05 Demolition of Buildings and <br /> other structures <br /> <br />No person shall demolish or wreck any building or <br />structure by means of fire, nor shall the debris <br />from a razed building be burned within the City of <br />Lakewood, except in facilities owned and operated <br />by the City of Lakewood, notwithstanding any other <br />provision of Chapter 37 of the General Offenses Code <br />to the contrary; provided, however, that in making or <br />constructing public improvements, such demolition or <br />wrecking by means of fire or burning of debris from <br />razed buildings may be permitted in areas designated and <br />under conditions and safeguards established by the <br />Director of Public Works and the Chief of the Division <br />of Fire. In designating areas of burning and establish- <br />ing conditions and safeguards therefore, the Director of <br />Public Works and the Chief of the Division of Fire <br />shall impose such rules and regulations or conditions as <br />will ensure that such burning will not endanger other <br />buildings and structures or the occupants thereof; that <br />such burning will be done expeditiously; that adequate <br />means are provided to control and confine said burning <br />to the designated area or areas; that the public health <br />and safety will not be endangered; that adequate mea- <br />sures are provided to clear and repair all adjacent <br />sidewalks and streets after completion of the burning <br />and such other rules, regulations or conditions as they <br />deem necessary, desirable or appropriate. <br /> <br /> <br />
