ORDINANCE NO. 13-67 BY: Messrs. Cain, Gaydos, Huffman~ Kelley, Usher, Ward and Wendltng. AN EMERGENCY ORDINANCE authorizing settlement of the claim of Helen M. Burton in the total amount of Two Hundred Dollars ($200.00), arising from a fall on Robinwood Avenue in the City of Lakewood, Ohio, on July 22, 1963. WHEREAS, This ordinance constitutes an emergency in that it may save the city from further expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Helen M. Burton, in the amount of Two Hundred Dollars ($200.00) is hereby ordered and authorized, conditioned upon the execution and delivery by Helen M. Burton of a full release in favor of the City of Lakewood, duly approved by the Director of Law. Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of Two Hundred Dollars ($200.00) to Helen M. Burton upon delivery to the Director of Finance of the foregoing release duly executed and approved; and to charge the same to the General Fund - Damages paid by City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all menfoers elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
