ORDINANCE NO. 33-67 BY: Messrs. %~ndling, Cain, Gaydo~~ Huffman, Kelley, Usher, ~ard AN EMERGENCY ORDINANCE authorizing the Mayor, on behalf of the City of Lakewood, to purchase the certain parcel of real estate located at 2021 Carabel Avenue in the City of Lakewood, hereinafter more particularly described. WHEREAS, This ordinance constitutes an emergency measure in that the owner has agreed to sell said property for the consider- ation hereinafter stipulated,which this Council deems to be in the best interest of the City and in that it provides for the public ~ealth and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT~ORDAINED BY THE COUNCIL OF T~E CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized to purchase, on behalf of the City of Lakewood, from the owner thereof, the following described parcel of property, together with Release of Dower, if any. ,~921 C~rabel Avenue Owner: Sarah J. ~iarsh, formerly known as Sarah J. Cohlhepp and State of Ohio Situated in the City of Lakewood, County of Cuyahoga_/and known as being Sublot No. 85 in the N. F. W. Bailey Re-Subdivision of part of Original Rockport Township Section No. 19, as shown by the recorded plat of said Re-Subdivision in Volume 58 of Maps, Page 23 of Cuyahoga County Records, and having a frontage of 40 feet on the Easterly side of Carabel Avenue, and extending back of equal width 134 feet deep, as appears by said plat, be the same more or less, but subject to all legal highways. and to pay therefore the sum of Twenty Four Thousand Dollars ($24,000.00) Section 2. That the title to said property shall be subject to the approval of the Director of Law; that taxes and assessments shall be prorated as of the date of transfer; that the Director of Finance be and he is hereby authorized to pay the amount set forth in Section 1 hereof from the Carabel Parking Lot Improvement Fund upon ~elivery by the Grantor of the Warranty Deed, together with release of dower, if any, to the City of Lakewood, together with guarantee of title disclosing the said real estate to be free and clear of all encumbrances, excepting taxes and assessments not yet due and payable, zoning ordinances and re- strictions of record, if any; and that the Director of Finance be and he is hereby authorized to pay the costs incidental to the completion of the purchase of said real estate, including the cost of recording the deed and one-half of the escrow agent's fee from said fund.
