ORDINANCE NO. 33-67 <br /> <br />BY: Messrs. %~ndling, Cain, Gaydo~~ <br /> Huffman, Kelley, Usher, ~ard <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor, on behalf <br />of the City of Lakewood, to purchase the certain parcel of real <br />estate located at 2021 Carabel Avenue in the City of Lakewood, <br />hereinafter more particularly described. <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure <br />in that the owner has agreed to sell said property for the consider- <br />ation hereinafter stipulated,which this Council deems to be in the <br />best interest of the City and in that it provides for the public <br />~ealth and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT~ORDAINED BY THE COUNCIL OF T~E CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized <br />to purchase, on behalf of the City of Lakewood, from the owner <br />thereof, the following described parcel of property, together with <br />Release of Dower, if any. <br /> <br />,~921 C~rabel Avenue <br />Owner: Sarah J. ~iarsh, formerly known as Sarah J. Cohlhepp <br /> and State of Ohio <br />Situated in the City of Lakewood, County of Cuyahoga_/and <br />known as being Sublot No. 85 in the N. F. W. Bailey <br />Re-Subdivision of part of Original Rockport Township Section <br />No. 19, as shown by the recorded plat of said Re-Subdivision <br />in Volume 58 of Maps, Page 23 of Cuyahoga County Records, <br />and having a frontage of 40 feet on the Easterly side of <br />Carabel Avenue, and extending back of equal width 134 feet <br />deep, as appears by said plat, be the same more or less, but <br />subject to all legal highways. <br /> <br />and to pay therefore the sum of Twenty Four Thousand Dollars <br />($24,000.00) <br /> <br /> Section 2. That the title to said property shall be <br />subject to the approval of the Director of Law; that taxes and <br />assessments shall be prorated as of the date of transfer; that <br />the Director of Finance be and he is hereby authorized to pay the <br />amount set forth in Section 1 hereof from the Carabel Parking Lot <br />Improvement Fund upon ~elivery by the Grantor of the Warranty Deed, <br />together with release of dower, if any, to the City of Lakewood, <br />together with guarantee of title disclosing the said real estate <br />to be free and clear of all encumbrances, excepting taxes and <br />assessments not yet due and payable, zoning ordinances and re- <br />strictions of record, if any; and that the Director of Finance be <br />and he is hereby authorized to pay the costs incidental to the <br />completion of the purchase of said real estate, including the cost <br />of recording the deed and one-half of the escrow agent's fee from <br />said fund. <br /> <br /> <br />
