ORDINANCE NO. 40~67 <br /> <br />BY: Messrs. Cain, Gaydos, Huffman, <br /> Kelley~ Ward, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing settlement of the <br />claim of Grace Giordano, in the total amoun~ of One Hundred <br />and Fifty Dollars ($150.00), arising Out of an accident when <br />she fell on a sidewalk near 1429 Owego AvenUe, LakeWood~ Ohio~ <br />on May 17, 1967. <br /> <br /> WHEREAS, This ordinance constitutes an emergency in <br />that it. may save the City from further expense and a possible <br />substantial jury verdict rendered against the City and in that <br />it provides for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. ~lat settlement of the claim of <br />Grace Giordano in the amount of One Hundred and Fifty Dollars <br />($150.00) is hereby ordered and authorized conditioned upon <br />the execution and delivery by Grace Giordano of a full release <br />in favor of the City of Lakewood0 duly approved by the Director <br />of Law° <br /> <br /> Section 2. That the Director of Finance be and he is <br />hereby authorized to pay the sum of One Hundred and Fifty <br />Dollars ($150o00) to Grace Giordano upon delivery to the <br />Dzrector of Finance of the foregoing release duly executed <br />and approved; and to charge the same to the General Fund - <br />Damages paid by the City. <br /> <br /> Section 3. That this ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the <br />preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Counczl~ it shall <br />take effect and be in force immediately upon its adoption and <br />approval by the Mayor. <br /> <br />Adopted: .
