ORDINANCE NO. 40~67 BY: Messrs. Cain, Gaydos, Huffman, Kelley~ Ward, Wendling AN EMERGENCY ORDINANCE authorizing settlement of the claim of Grace Giordano, in the total amoun~ of One Hundred and Fifty Dollars ($150.00), arising Out of an accident when she fell on a sidewalk near 1429 Owego AvenUe, LakeWood~ Ohio~ on May 17, 1967. WHEREAS, This ordinance constitutes an emergency in that it. may save the City from further expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. ~lat settlement of the claim of Grace Giordano in the amount of One Hundred and Fifty Dollars ($150.00) is hereby ordered and authorized conditioned upon the execution and delivery by Grace Giordano of a full release in favor of the City of Lakewood0 duly approved by the Director of Law° Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of One Hundred and Fifty Dollars ($150o00) to Grace Giordano upon delivery to the Dzrector of Finance of the foregoing release duly executed and approved; and to charge the same to the General Fund - Damages paid by the City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Counczl~ it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
