(e) in the execution of Urben Renewal or Redevelopment Projects, <br />the Council may authorize, as to any appropriate projects or parts of <br />projects, the employment of community improvement corporations, conm~unity <br />redevelopment corporations, and metropolitan housing authorities, as <br />defined by the statutes of Ohio, and when authorized by ordinance of the <br />Council may grant leases, make conveyances and enter into agreements with <br />such corporations related to appropriate aspects of such projects to the <br />full extent of the powers possessed by such corporations. <br /> <br />Section 12. I~I?.~CE <br /> <br /> The cost of Urban Renewal activities may be paid in whole or in <br />part by the City from appropriate genersl or special funds or accounts <br />established pursuant to Chapter 135 and Chapter 5705 and the City may <br />accept grants or gifts of moneys or real or personal property from persons, <br />entities, governments or taxing authorities to be used for the planning <br />and financing of such Urban Renewal activities. All bonds or notes payable <br />from the general credit and taxes of the City to finance the Urban Renewal <br />activities shall be issued in accordance with the applicable provisions of <br />Chapter 133 of the Revised Code. <br /> <br />Section 13. BUILDING PERMITS <br /> <br /> After approval of an Urban Renewal or Redevelopment Plan by the <br />Council, no building permit shell be issued for the improvement or enlarge- <br />ment of any existing structure, or for the construction of a new structure, <br />in the clearance and r~evelopment portion of the Project Area, except that <br />such permit may ~ issued for the repair of an existing structure when such <br />repair is d~¢~,~d necessary for the immediate preservation of the public <br />health a=d safety or is required by the rmdeveloper in accordance with the <br />~-~Iopment plan. <br /> <br />Section 14. TAX EXE~PTION <br /> <br /> (a) All property of the City, including funds, owned or held by <br />it for the purposes of this ordinance, shall be e:~empt from levy and sale <br />by virtue of an execution, and no execution or other judicial process shall <br />issue against the same nor shall judgment against the City be a charge or <br />lien upon such property; provided, however, that the provisions of this <br />section shall not apply to or limit the right of obligees to pursue any <br />remedies for the enforcement of any pledge or lien §iron pursuant to this <br />ordinance by the City on its rents, fees, grants or revenues from urban <br />renewal or redevelopment projects. <br /> <br /> (b) The property of the City, acquired or held for the purposes of <br />this ordinance on January i of any year, is declared to be public property· <br />used exclusively for essential public and governmental purposes and such <br />property shall be exempt from all t~:es of the City, County, State or any <br />taxing authority thereof; provided, however, that s~ch tax exemption shall <br />terminate when the City sells, leases or otherwise disposes of such <br />property in a project area to a purchaser or lessee which is not a person, <br />corporation, partnership or other association entitled to tax exemption with <br />respect to such property. <br /> <br />Section 15. SEPAF~kBILITY: ORDIiTiAi~ CE CONTROLLING <br /> <br /> Notwithstanding any other evidence of legislative intent, it is <br />hereby declared to be the controlling legislative intent that if any provi- <br />sion of this ordinance, or the application thereof to any person or circum- <br />stances, is held invalid, the remainder of the ordinance and the application <br />of such provision to persons or circumstances other than those to which it <br />is held invalid, shall not be affected thereby. <br /> <br /> Insofar as the provisions of this ordinance are inconsistent with <br />the provisions of any other law or ordinance: the provisions of this <br />ordinance shall be controlling. The powers conferred by this ordinance <br />shall be in addition and supplemental to the powers conferred by other law. <br /> <br />Section 16. EMERGE?~CY <br /> <br /> 7or the reason that it is essential to establish the urban renewal <br />procedures and mare the findings and take the other action hereinabove set <br />forth as soon as possible in order to expedite the urban renewal program <br />vitally necessary because of the existence of blighted, deteriorated and <br /> <br />~ 8 - <br /> <br /> <br />
