ORDINANCE NO. 67-67 BY~ssrs. Graber, Huffman, Kelley, <br /> Usher, Ward, Wendling & Gaydes <br /> AN EMERGENCY ORDINANCE to amend Section 967.19 of the General <br />Offenses Code of the Codified ordinances of the City of Lakewood <br />relating to trespassing upon the lands or premises of another. <br /> WHEREAS~ This ordinance constitutes an emergency measure <br />providing for the i~ediate preservation of the public peace and <br />saf.ety and for the usual daily operation of a municipal department; <br />now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> Section 1. That Section 967.19 of the General Offenses Code <br />of the codified Ordinances of the City of Lakewood, now reading aS <br />follows: <br /> <br /> Section 967.19 Trespassing upon lands or premises of <br /> another; penalty <br /> "(a) No person shall enter without lawful authority upon the <br /> land or premises of another~ or bezng upon the land or <br /> premises of another, upon being notified to depart therefrom <br /> by the owner or occupant, or the agent or servant of either,· <br /> without lawful authority neglect or refuse to depart <br /> therefrom. <br /> (b) whoever violates this section shall be fined not more <br /> than fifty dollars ($50.00) or imprisoned not more than <br /> thirty (30) days, or both." <br /> <br /> be and the same is hereby amended to read as follows: <br /> <br /> Section 967.19 Trespassing upon lands, premises or motor vehicles of another; penalty <br /> <br />(a) No person shall enter without lawful authority upon <br />the land or premises of another, or being upon the land <br />or premises of another, upon being notified to depart <br />therefrom by the owner or occupant~ or the agent or <br />servant of either, without lawful authority neglect or <br />refuse to depart therefrom. <br /> <br />(b) No person shall enter or be upon a motor vehicle which <br />is the property of another without the permission or <br />consent of the owner thereof. <br />(c) No person shall leave an unoccupied motor vehicle on <br />the land or premises of ~nother except with the consent and <br />knowledge of the owner or occupant, or their agent or <br />servant. If any motor vehicle is found upon the land or <br />premises of another in violation of this section and the <br />identity of the driver cannot be determined~ the owner or' <br />person in whose name such vehicle ms regzstered shall be held <br />prima-facie responszble for such violation. <br /> (d) Whoever violates subdivisions (a) or (c) of this sectio~ <br /> shall be fined not H~ore than fifty dollars ($50.00). Who- <br /> ever violates subdivision (b) of this section shall be fined <br /> not more than one hundred dcllars ($100.00) or imprisoned not <br /> more than thirty days, or both. <br /> <br /> <br />
