ORDINANCE NO. 69-67 BY: Messrs. Gaydos, Huffman, Kelley, Usher, Ward, Wendling and Cain AN EMERGENCY ORDINANCE authorizing settlement of the claim of Mildred Shimola, not married, in the total amount of Two Hundred and Fifty Dollars ($250.00), arising out of an accident when she fell on Edwards Avenue near clifton Boulevard in the City of Lakewood, Ohio, on January 15, 1964. WHEREAS, This ordinance constitutes an emergency in that it may save the City from further expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daily operation of a municipal depart- ment; now, therefore, BE IT ORDAINED BY THE COUNCIL OF T~ CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of ~ildred Shimola~ in the amount of Two Hundred and Fifty Dollars ($250.00) is hereby ordered and authorized, conditioned upon the execu%io~ and delivery by Mildred Shimola of a full release in favor of the City of Lakewood, duly approved by the Director of Law. Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of Two Hundred and Fifty Dollars ($250.00) to Mildred Shimola~ upon delivery to the Director of Finance of the foregoing release duly executed and approved; and to charge the same to the General Fund - Damages paid by the City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereo~ and provided it receives the affirmative vote of two-thirds of all members elected to Council~ it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
