<br /> AN EMERGENCY ORDINANCE providing for the sale of
<br />certain real property located at the northeast corner of
<br />Franklin Boulevard and Olivewood Avenue in the City of
<br />Lakewood, Ohio.
<br /> WHEREAS, The said real property (hereinafter described
<br />in the body of the agreement) owned by the City of Lakewood,
<br />is no longer needed for any municipal purpose, and,
<br /> WHEREAS, For the foregoing reason, it is in the best
<br /> interest of the City of Lakewood that said real property be
<br /> sold, and,
<br /> WHEREAS, The Board of Control of the City of Lakewood
<br /> has directed that said real property be sold, and,
<br /> WHEREAS, This ordinance constitutes an emergency
<br /> measure providing for the immediate preservation of the public
<br /> health, safety and welfare and for the usual daily operation of
<br /> a municipal department; now, therefore,
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD,
<br /> STATE OF OHIO:
<br /> Section 1. It is hereby determined that the real
<br /> property described in the agreement set forth herein is no
<br /> longer needed for municipal purposes.
<br /> Section 2. This Council hereby authorizes the sale of
<br /> said land to Levi E. Troyer and Anna J. Troyer, husband and wife,
<br /> and the Mayor is authorized and directed to execute, on behalf
<br /> of the City of Lakewood, a contract for the sale of said
<br /> property, in substantially the following form:

<br />
<br />THIS AGREEMENT made and concluded at Lakewood, Ohio, this
<br /> ...day of September, 1968, by and between the City of
<br />Lakewood, whose mailing address is 12650 Detroit Avenue,
<br />Lakewood, Ohio, hereinafter called the "VENDOR" and
<br />Levi E. Troyer and Anna J. Troyer, husband and wife, whose
<br />mailing address is 1525 Olivewood Avenue, Lakewood, Ohio,
<br />hereinafter called the "VENDEES".

<br />WITNESSETH:
<br />That in consideration of the mutual promises of the parties
<br />here~n contained, the VENDOR agrees to sell and convey and
<br />the VENDEES agree to purchase and pay for, upon and under
<br />the provisions, terms and conditions herein expressed, the
<br />following described premises situated in the City of
<br />Lakewood, County of Cuyahoga and State of Ohio, and known
<br /> as being a part of original Rockport Township Section No.
<br />22, being part of Sublot Number 84 in the J. W. Hamby's
<br /> Lakewood Subdivision as shown by the recorded plat in Volume
<br /> 28 of Maps, Page 26 of Cuyahoga County Records, and bounded
<br /> and described as follows:
<br /> Beginning at the southx~esterly corner of Sublot Number 85
<br /> in the J. W. Hamby's Lakewood S~bdiviSiOn as shown bY the
<br /> recorded plat in Volume 28 of 14aps, Page 26 of Cuyahoga
<br /> County Records, thence easterly along the southerly line of
<br /> '~aid sublot a distance of 70.00 feet to a point in the
<br /> easterly line of 's&i~ subdivision; thence southerly along
