ORDINANCE NO. 89-68 BY: Messrs. Graber, Huffman, Kelley~ Usher, Ward, Wendling, Gaydos AN EMERGENCY ORDINANCE authorizing settlement of the claim of Lillian Bert, a widow, not remarried, in the total amount of Two Hundred Dollars ($200..00) arising out of an accident when she fell on the public sidewalk adjacent to the premises located on the west side of Highland Avenue immediately south of the railroad right-of-way in the City of Lakewood, Ohio, on October 24, 1964. WHEREAS, This ordinance constitutes an emergency measure in that it may save the City from further expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daily operation of a muni- cipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Lillian Bert, in the amount of Two Hundred Dollars ($200.00), is hereby ordered and authorized, conditioned upon the execution and delivery by Lillian Bert of a full release in favor of the City of Lakewood, duly approved by the Director of Law. Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of TWo Hundred Dollars ($200.00) to Lillian Bert, upon delivery to the Director'of Finance of the foregoing release duly executed and approved; and to charge the same to the General Fund - Damages paid by the City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
