ORDINANCE NO. <br /> <br />89-68 <br /> <br />BY: Messrs. Graber, Huffman, Kelley~ <br /> Usher, Ward, Wendling, Gaydos <br /> <br /> AN EMERGENCY ORDINANCE authorizing settlement of <br />the claim of Lillian Bert, a widow, not remarried, in the total <br />amount of Two Hundred Dollars ($200..00) arising out of an accident <br />when she fell on the public sidewalk adjacent to the premises <br />located on the west side of Highland Avenue immediately south of <br />the railroad right-of-way in the City of Lakewood, Ohio, on <br />October 24, 1964. <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure in that it may save the City from further expense and a <br />possible substantial jury verdict rendered against the City <br />and in that it provides for the usual daily operation of a muni- <br />cipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That settlement of the claim of Lillian <br />Bert, in the amount of Two Hundred Dollars ($200.00), is hereby <br />ordered and authorized, conditioned upon the execution and <br />delivery by Lillian Bert of a full release in favor of the City <br />of Lakewood, duly approved by the Director of Law. <br /> <br /> Section 2. That the Director of Finance be and <br />he is hereby authorized to pay the sum of TWo Hundred Dollars <br />($200.00) to Lillian Bert, upon delivery to the Director'of <br />Finance of the foregoing release duly executed and approved; and <br />to charge the same to the General Fund - Damages paid by the City. <br /> <br /> Section 3. That this ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two-thirds <br />of all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />December 16. 1968 <br /> <br />aoberc W, ,adl g <br /> President <br /> <br />Grace Reynolds <br /> <br />Approved: December 16~ 1968 <br /> <br />Robert M.
