ORDINANCE NO. 3-69 ~=ssrs. GaydoS, Graber, Huffman, Kelley, Usher, Ward AN Eb~RGENCY ORDINANCE to appropriate property at and known as being 1377 Gladys Avenue, Lakewood, Ohio. WHEREAS, On the 6th day of January, 1969, the Council of the City of Lakewood, Ohio, adopted Resolution No. 4683, declaring the necessity and intention of appropriating the land hereinafter described, notice of the adoption of which resolution has been served on the owners, persons in possession or having an interest of record in said land, and, WHEREAS, This ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the fee simple interest in and to the following described real estate be and the same is hereby appropriated for the purpose of construction of off-street parking facilities for the City of Lakewood, Ohio: Situated in the City of Lakewood, County of Cuyahoga and State of Ohio, and known as being part of Original Rockport Township Section No.22, and bounded and described as follows: Beginning on the easterly line of Gladys Avenue, as dedicat- ed by plat recorded in Volume 33 of Maps, Page 5 of Cuyahoga County Records, at the Northwesterly corner of land conveyed to Mary E. Loew by Deed dated March 19, 1908 and recorded in Volume 1136, Page 555 of Cuyahoga County Records; thence Southerly along said Easterly line of Gladys Avenue 40 feet; thence Easterly and parallel with the Northerly line of land so conveyed to Mary E. Loew, about 100.24 feet to the Easterly line thereof; thence Northerly along the Easterly line of land so conveyed to Mary E. Loew, 40 feet to the Northeasterly corner thereof; thence Westerly along the Northerly line of land so conveyed, about 100.24 feet to the place of beginning and being further known as the Northerly 40 feet of Sub Lot No. 4 in Wigmore and Stuart's proposed Subdivision, be the same more or less, but subject to all legal highways .. 'Section 2. That the Director of ~aw be and he hereby is authorized and directed to apply to a court of competent juris- diction to have a jury impanelled to make inquiry into and assess the compensation to be paid for the fee simple interest in said property. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons set forth in the preamble hereof and provided it receives the affirmative vote of two- thirds of all merabers elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
