ORDINANCE NO. <br /> <br />6-69 <br /> <br />BY* Messrs. Gaydos~ Graber, <br /> Huffman, Kelley, Usher, <br /> Wendling <br /> <br /> AN EMERGE~ICY ORDINANCE to vacate a portion of Thoreau <br />Avenue in the City of Lakewood, hereinafter more particularly <br />described° <br /> <br /> W~IEREA&'~ On the 161-.t~ day of Decemlber. 1968, the Council <br />of the City of Lakewood ~depted Resolution No- 4676~ d~eclaring <br />its intention to vacate a portion of Thoreau Avenue, and, <br /> <br /> WHEREAS, Notice of the adoption of ~ above Resolution <br />No. 4676 has been served upoD the owners of all the property <br />abutting Thoreau Avenue affected by said resolution, notifying <br />the said property owners of the time and place at which objections <br />can be heard before the Board of Revision of Assessments, and, <br /> <br /> WHEREAS, On the 16th day of January, 1969, the Board of <br />Revision approved the vacation of a portion of Thoreau Avenue, <br />hereinafter more particularly described, in accordance with <br />the provisions of Article XIV, Section 28 of the Amended <br />Charter of the City of Lakewood, and, <br /> <br /> WHEREAS, This Council is satisfied that there is good <br />cause for vacating a portion of Thoreau Avenue and that it will <br />not be detrimental to the general interest and ought to be <br />made, and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the following described property be and <br />the same is hereby vacated: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga, <br />State of Ohio, and known as being part of original <br />Rockport Township Section Number 21 and bounded and <br />described as follows: <br /> <br /> (East Side) <br />Beginning at the NOrthwesterly corner of Sublot Number 12 <br />in the J. A. Zangerle Subdivision as shown by the recorded <br />plat in Volume 34 of Maps, Page 7 of Cuyahoga County <br />Records; thence Southerly along the Easterly line of Thoreau <br />Avenue (78 feet wide) a distance of 44.82 feet to the <br />principal place of beginning; thence Southerly along the <br />Easterly line of Thoreau Avenue (78 feet wide) a distance <br />of 675.57 feet 'which is 'the Southwesterly corner of Sublot <br />Number 27 in the said subdivision; thence Westerly along <br />the Southerly line of said subdivision a distance of 16.00 <br />feet; thence Northerly and parallel to the centerline of <br />Thoreau Avenue a distance of 625.34 feet; thence North- <br />easterly a distance of B2.50 feet to the principal place <br />of beginning, be the same more or less, but subject to all <br />legal highways. <br /> <br />Post-lY" brand fax transmittal memo 7671 1 # of pages <br />co.
