- 2 - <br /> <br /> The second party further agrees to pay promptly, upon <br /> receipt of invoice therefor, any sum charged as compen- <br />.'sation for loss or damage to equipment or ~pparatus while <br /> engaged outside the limits of the City of Fairview Park <br /> under this agreement, <br /> <br />The second party further agrees fully and 'promptly to <br />reimburse the City of Fairview Park, or the Firemen's <br />Relief and Pension Fund, as the case may be, for any~ <br />pension or indemnity or premium contribution assessed <br />against the City of Fatrview Park for Workmen's Compen- <br />sation benefits for injuries or death of members of the <br />Division of Fire occurring while engaged in rendering <br />service under th£s agreement. <br /> <br />This agreement shall in no event be held or construed as <br />conferring a right of action for damage on any property <br />owner or any other person, firm or corporation for the <br />operation or failure to operate hereunder. <br /> <br />Second party agrees to furnish like apparatus and service <br />to the City of Fatrview Park under the same terms and <br />conditions hereinabove applicable to t~e furnishing of <br />such apparatus and service to second party by the City of <br />FairView Park. <br /> <br />This contract shall'be~in'full force and effect between <br />the parties hereto, until either of the parties hereto <br />gives written notice tO the other party of its intention <br />to terminate this Agreement and withdraw therefrom, and <br />then this Contract shall terminate thirty (30) days after <br />receipt of said written notice. <br /> <br /> IN WITNES~ WHEREOF, the parties hereto have set their hands <br />as of the date first above written. <br /> <br />SIGNATURES <br /> <br />Section 2. That the officers authorized to request the City of Fairview <br />Park to furnish the apparatus and service as provided in said agreement <br />are hereby designated to be: The Mayor, the Acting Mayor, the Chef of <br />the Division of Fire, and the Assistant Chiefs of the Division of Fire. <br /> <br />Section 3. This ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and <br />approval by the Mayor. <br /> <br /> <br />
