ORDINANCE NO. 60-69 <br /> <br />BY: Messrs. Gaydos, G~bcr Hu-ffman, <br /> Usher, Ward, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 509.10(a) of the General <br />Offenses Code of the Codified Ordinances of the City of Lakewood <br />relating to unlawful congregation in the City of Lakewood. <br /> <br /> WHEREAS, The shopping centers and retail business districts <br />of the City, including parking lots, have become hangouts for <br />teenagers and young adults,with loitering and the use of abusive <br />and obscene language in public, endangering the comfort, repose, <br />peace and safety of shoppers, pedestrians and residents in the <br />immediate vicinity and it is necessary to regulate and maintain <br />order in and around said shopping centers and retail business <br />districts of the City~ and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF. LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 509.10(a) of the General Offenses Code of <br />the Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />Section 509.10 Unlawful congregation on sidewalks, public grounds. <br /> <br />"(a) <br /> <br />No person shall congregate with others on the sidewalk, <br />street corner or within the parks or public grounds, with <br />intent to provoke 'a breach of the peace; or whereby a <br />breach of the peace may be occasioned by the serious <br />annoyance to pedestrians or by threatening, insulting <br />or abusive conduct to them; or refuse to move on when <br />ordered by a police officer." <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />Section 509.10 Unlawful congregation on sidewalks, public <br /> grounds, and other areas. <br /> <br />(a) <br /> <br />No person shall congregate with others on the sidewalk, <br />street corner, within the parks or public grounds, or in <br />or about the shopping centers and retail business districts <br />of the city, including but not limited to the areas desig- <br />nated by the property owner for off-street parking, the <br />ingress and egress thereto, driveways, sidewalks, malls, <br />arcades, service areas and the entranceways into stores <br />and buildings, with intent to provoke a breach of the <br />peace; or whereby a breach of the peace may be occasioned <br />by the serious annoyance to shoppers, pedestrians or <br />residents in the immediate vicinity; or by threatening, <br />· insulting or abusive conduct to 'them; or for the purpose <br /> '.of lingering or loitering in any ~anner whiCh will obstruct, <br /> impede or interfere with the free passage of other persons <br /> using said areas; or refuse to move on when ordered by a <br /> police officer. <br /> <br /> <br />
