ORDINANCE <br /> <br />25-70 <br /> <br />BY: Messrs. Huffman, Kelley, Usher, <br /> Ward, Wending, Gaydos, Graber <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of <br />Public Works to charge a fee for tennis playing during specified <br />hours on the tennis courts located in Lakewood Park and repealing <br />Ordinance No. 14-70, adopted April 6, 1970, and all other ordinances <br />or parts of ordin~%ces inconsistent' herewith. <br /> <br /> WHEREAS, The demand for the use of municipal tennis <br />courts is such that regulation thereof is mandatory, and, <br /> WHEREAS, This ,ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he <br />is hereby authorized to charge a fee for tennis playing on the <br />I~kewood Park tennis courts between the hours of 5 P.M. and 11 P.M. <br />on weekdays and between the hours of 12 Noon.to 11' P.M. on Saturdays, <br />Sundays and holidays, as follows: <br /> <br /> $20.00 for a pass issued to a City of Lakewood resident, <br /> which entitles such resident to use said courts during <br /> the tennis season of the year for which such pass is <br /> issued; <br /> <br /> $35.00 for a pass issued to a non-resident of the city of <br /> Lakewood, which pass entitles such non-resident to use <br /> said courts during the tennis season of the year for which <br /> such pass is issued; <br /> <br /> The right of pass holders to the use of said courts shall be <br /> subject to availability thereof for play. <br /> <br /> 75¢ per hour shall be charged all persons not having a <br /> pass, using said courts during the hours, and on the d~ys <br /> mentioned in paragraph one of this section. <br /> <br /> ~he Director of Public Works is further authorized to charge <br /> a fee of-$30.00 for the instructional course consisting of <br /> six .(6) sessions (2 sessions per week for three consecutive <br /> specified weeks) of one hour each. <br /> <br /> The Director of Public Works is further authorized to charge <br /> a fee of $10.00 per person for group instructional courses' <br /> consisting of six (6) sessions of one hour each. <br /> <br /> The tennis season shall extend from April to October of <br /> each year, the specific dates for. opening and closing of <br /> such season shall be fixed by the Director of Public Works. <br /> <br /> Section 2. That this ordinance is hereby declared to be <br /> an emergency measure for the reasons stated in the preamble hereof <br /> and provided it receives the affirmative vote of two-thirds of all <br /> members elected to Council, it shall take effect and be in force <br /> <br /> <br />
