ORDINANCE NO. 52-70 BY: Messrs. Gaydos, Graber, Huffman, Kelley, Usher, Ward, Wendling AN EMERGENCY ORDINANCE to provide for the submission to the electorate of an amendment to The Amended Charter of the City of Lakewood by enacting a new Section 31 of Article XIV thereof, per- taining to a levy to provide funds to operate the Division of Fire of the City of Lakewood, Ohio. WHEREAS, an emergency exists in that this Charter amend- ment is to be presented to the electorate of the City of Lakewood at the general election to be held on the 3rd day of November, 1970, and, WHEREAS, This ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of municipal departments; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: Section 1~. That the question of the amendment to The Amended Charter of the City of Lakewood, Ohio by enacting new Section 31 of Article XIV, so that same shall be and read as follows: Section 31. Levy for all monies to operate the Division of Fire of the City of Lakewood, Ohio. "Notwithstanding any other provision of the Charter of the City of Lakewood, ~and in addition to all other levies authorized or required by law,. but otherwise in the manner provided for the making of other municipal levies, the Council shall levy annually, without a vote of the people, outside of the constitutional and statutory ten (10) mill limitation and outside of the/limitations provided by this Charter, a tax upon all real and personal property listed for taxation upon the first available tax lists and duplicates and on such lists and duplicates in each year thereafter sufficient in rate to provide all monies for the operation of the Division of Fire of the City of Lakewood, Ohio." be submitted to a vote of the qualified electors of the City at the general election to be held on Tuesday, the 3rd day of November, 1970, at the regular places of voting in the City between the hours of 6:30 a.m. and 6:30 p.m. Section 2. That the ballots for said election shall, at the top thereof, be entitled, "City Charter Amendment Ballot" and the question to be submitted on said ballot shall be in words following: "Shall the proposed amendment enacting new Section 31 of Article XIV of the Amended Charter of the City of Lakewood: Notwithstanding any other provision of The Amended Charter of the City of Lakewood, and in addition to all other levies authorized or required by law, but otherwise in the manner provided for the making of other municipal levies, the Council shall levy annually, without a vote of the people, outside of the constitutional and statutory ten (10) mill limitation and outside of the limitations provided by. this Charter, a tax upon all real and personal property listed for taxation upon the first available tax lists and dupli- cates and on such lists and duplicates in each year there- after sufficient in rate to provide all monies for the operation of the Division of Fire of the City of Lakewood, Ohio." be adopted?"
