ORDINANCE NO. 52-70 <br /> <br />BY: Messrs. Gaydos, Graber, Huffman, <br /> Kelley, Usher, Ward, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to provide for the submission to <br />the electorate of an amendment to The Amended Charter of the City of <br />Lakewood by enacting a new Section 31 of Article XIV thereof, per- <br />taining to a levy to provide funds to operate the Division of Fire <br />of the City of Lakewood, Ohio. <br /> <br /> WHEREAS, an emergency exists in that this Charter amend- <br />ment is to be presented to the electorate of the City of Lakewood at <br />the general election to be held on the 3rd day of November, 1970, and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare and for the usual daily operation of municipal departments; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: <br /> <br /> Section 1~. That the question of the amendment to The <br />Amended Charter of the City of Lakewood, Ohio by enacting new Section <br />31 of Article XIV, so that same shall be and read as follows: <br /> <br />Section 31. <br /> <br />Levy for all monies to operate the Division <br />of Fire of the City of Lakewood, Ohio. <br /> <br />"Notwithstanding any other provision of the Charter of the <br /> City of Lakewood, ~and in addition to all other levies <br /> authorized or required by law,. but otherwise in the manner <br /> provided for the making of other municipal levies, the <br /> Council shall levy annually, without a vote of the people, <br /> outside of the constitutional and statutory ten (10) mill <br /> limitation and outside of the/limitations provided by this <br /> Charter, a tax upon all real and personal property listed <br /> for taxation upon the first available tax lists and duplicates <br /> and on such lists and duplicates in each year thereafter <br /> sufficient in rate to provide all monies for the operation <br /> of the Division of Fire of the City of Lakewood, Ohio." <br /> <br />be submitted to a vote of the qualified electors of the City at the <br />general election to be held on Tuesday, the 3rd day of November, 1970, <br />at the regular places of voting in the City between the hours of 6:30 <br />a.m. and 6:30 p.m. <br /> <br /> Section 2. That the ballots for said election shall, at <br />the top thereof, be entitled, "City Charter Amendment Ballot" and the <br />question to be submitted on said ballot shall be in words following: <br /> <br /> "Shall the proposed amendment enacting new Section 31 of <br /> Article XIV of the Amended Charter of the City of Lakewood: <br /> Notwithstanding any other provision of The Amended Charter <br /> of the City of Lakewood, and in addition to all other levies <br /> authorized or required by law, but otherwise in the manner <br /> provided for the making of other municipal levies, the <br /> Council shall levy annually, without a vote of the people, <br /> outside of the constitutional and statutory ten (10) mill <br /> limitation and outside of the limitations provided by. this <br />Charter, a tax upon all real and personal property listed <br /> for taxation upon the first available tax lists and dupli- <br /> cates and on such lists and duplicates in each year there- <br /> after sufficient in rate to provide all monies for the <br /> operation of the Division of Fire of the City of Lakewood, <br /> Ohio." <br /> <br />be adopted?" <br /> <br /> <br />
