ORDINANCE NO. 1 73-70 BY: Messrs. Ward, Wendling, Gaydos, Graber, Huffman, Kelley, Usher AN EMERGENCY' ORDINANCE authorizing settlement of the claim of Patricia Fulkerson, married, in the total amount of One Hundred Fifty Dollars {$150.00), arising out of an accident when she fell in the crosswalk on Madison Avenue at the east side of the Warren Road intersection, Lakewood, Ohio., on December 19, 1964. WHEREAS, This ordinance constitutes an emergency in that it will save the City further legal expense and a possible substan- tial jury verdict rendered against the City and in that it provides for the usual daily operation of a municipal department; now, there- fore, BE IT ORDAINED BY T~E COUNCIL' OF THE.'CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Patricia Fulkerson, married, in the amount of One Hundred Fifty Dollars ($150.00) is hereby ordered and authorized, conditioned upon the execution and delivery by Patricia Fulkerson, married, of~a full release in favor of the City of Lakewood,.~duly approved by the Dir- ector of Law. Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of One Hundred Fifty Dollars ($150.00) to Patricia Fulkerson, married, upon delivery to the Dir- ector of Finance of the foregoing release duly executed and approved; and to charge the same to the general fund'- damages paid by the City. Section' 3. .That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to, Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
