D., as Conuuissioncr of llealth, <br /> whereby thc City of Lakcwood agrees to indemnify said tlcalth <br />'Co~issioncr from any loss, damages, costs and expenses~ which said <br /> tIealth Conunissioner may incur, suffer or be legally required to <br /> pay as damages by reason of; any liability arising out of or connected <br /> with his duties as IIcalt[u Cg~issioner. <br /> <br /> ~IEREAS, the professional liability insurance policy pr.esently <br /> owned by Garry G. Bassett, M. D., specifically excludes protection <br /> against any loss or damages which might be suffered or incurred by <br /> the said Garry G. Bassett, M. D., 'arising out of or in any way <br /> connected with his duties as Co~nissioner of Health of the City of <br /> Lakewood. <br /> <br /> WHEREAS, said Commissioner deems such protection essential <br />as a condition to his continued employment with the City of Lakewood <br />in his capacity as Health Commissioner, and, <br /> <br /> WHEREAS, the City of Lakewood deems it essential, to the <br />preservation of the public health, safety and welfare, and for its <br />best interests to retain the services of said Commissioner of Health <br />and to enter into an Indemnity Agreement in ~he manner and form <br />hereinafter set forth, and, <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized <br />and directed on behalf of the City of Lakewood, to enter into an <br />indemnity agreement with Garry G. Bassett, M. D., Health Commissioner, <br />which indemnity agreement is substantially as set forth in Exhibit <br />"A" attached hereto and made a part hereof. <br /> <br /> Section 2. That this ordinance is hereby ·declared to be <br />an emergency measure for the reasons Stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br />President <br /> <br />Clerk <br /> <br />Approved <br /> <br />Mayor <br /> <br /> <br />
