Grsber, 'Huffman, <br /> Usher~ Ward, Gaydos <br /> <br /> AN ~RGEE;CY ORDIN~ICE to levy soecial assessments for ~he im- <br />provement of Rio Street in mhe City of Lak~woo~, Ohio, between certain <br />termini by the necessary grading of the base, resurfacing with asphaltic <br />concrete including %he necessary replacemen~ and resetting of castings <br />and the necessary resetting and replacing of curbs ~ogether with ~he necessaz~y <br />appurtenances ~hereto. <br /> <br /> WHERE,, this Council by ~wo-thirds vote of the members elected <br />thereto dete~mines that ~his ordinance is au emergency measure which is <br />necessary for the ir~edia~e oreservation of ~he.~ublic oeace, proper~y, <br />health ~ud safe~y and for the ~h~rther reason ~hat the assessments'herein <br />provided for must be promptly levied'in order ~o retire outstanding no%es <br />by the issuance of bonds and ~hereby preserve~the credit of the City. <br /> <br /> NOW, THEP~FORE, BE IT 0EDAiNEDby the Council of'the City of <br />Lakewood, Cuyahoga County, State of Ohio: <br /> <br /> Sectionl. That the assessmen~ of the cost and expense of improving <br /> Bio Street from Detroit .Extension ~o Sounherly ~erminus in the City of <br /> Lakewood, Ohio, by the necessary grading of the base, resurfacing~i~h <br /> asphaltic concrete including the necessa~y ~replacemen~ ~nd rese~ing of <br /> castings and the necessary rese~zing ~nd replacing of curbs toge=her with <br />-the necessaz~y appurtenances thereto as set forth in Resolution No. 4761 <br /> adopted by this Council on February 16, 1970 and ar~oun=ing in the aggregate <br /> to $2,113.bl as reported to'this Council on the 15th day of March, 1971, <br /> by the Direc=or of Finance, be and the same is hereby adopted and confirmed, <br /> and that there be and are herebylevied ~nd assessed uoon the lots and <br /> lands bounding and abutting upon said improvemen~ the several ar~oun~s <br /> reported as aforesaid, which assessments and the description of said lots <br /> and lauds are now on file in the office of ~he Clerk of Council and which <br /> assessments are in proportion to the sneci~_l benefits, ~nd are mom in <br /> excess of any statutory limitation'. <br /> <br /> Section 2. ~nat the total assessment against each lot or parcel <br />of l~ud shall be payable in cash no= later than May 15, 1971, or at the <br />option of the owner, in five annual installments with interest at the <br />same rate as shall be borne by the bonds to be issued in anticipation <br />of the collection of the same. All cash payments shall be made to the <br />Director of Finance of said City. All assessments and installments thereof <br />remaining unpaid a~ the expira~ion~of said-period shell be certified by <br />the Director of Finmnce ~o the County Auditor as provided by law ~o be <br />placed by him on the tax duplicate and collected as other ~axes are collected. <br /> <br /> Section B.
