ORDINANCE NO. 26-71 <br /> <br />BY' <br /> <br />Messrs. Graber, Huffman, Kelley, <br />Usher, Ward, Wendling, Gaydos <br /> <br /> AN EMERGENCY ORDINANCE authorizing settlement of the <br />claim of Harry Paul, Jr.., Administrator of the Estate of Harry <br />Paul III, in the total amount of Two Thousand Two Hundred and <br />Fifty Dollars ($2,250.00), arising out of an incident which <br />occured at the Charles A. Foster Pool in Lakewood Park on or <br />about June 12, 1964, on which date the Plaintiff's son drowned <br />in said pool. <br /> <br /> WHEREAS, this ordinance constitutes an emergency in <br />that it will save the City further legal expense and a'possible <br />substantial jury verdict rendered against the City and in that it <br />provides for the usual daily operation of a municipal departr%ent, <br />now, therefore, <br /> <br /> BE IT ORDAINED BY'THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That settlement of the claim of Harry Paul, <br />Jr., Administrator of the Estate of Harry Paul III, in the amount <br />of Two Thousand ~o Hundred and Fifty Dollars ($2,250.00), is <br />hereby ordered and authorized conditioned upon the execution and <br />delivery by Harry Paul, Jr., Administrator, of a full release in <br />favor of the C~y of Lakewood and the Lakewood Board of Education, <br />duly approved by the Director of Law and the approval of said <br />settlement by the Probate Court of Cuyahoga County, Ohio. <br /> Section 2. That the Director of Finance be and he is <br /> hereby authorized to pay the sum of Two Thousand Two Hundred and <br /> Fifty Dollars ($2,250.00) to Harry Paul, Jr., Administrator, upon <br /> delivery to the Director of Finance of the foregoing release duly <br /> executed and approved, and a certified copy of the Journal Entry <br /> of the Probate Court of Cuyahoga County approving said settlement, <br /> and to charge the same to the General Fund - damages paid by the <br /> City. <br /> <br /> Section 3. That this ordinance is hereby declared to be <br /> an emergency measure for the reasons stated in the preamble hereof <br /> and provided it receives the affirmative vote of two-thirds of all <br /> members elected to Council, it shall take effect and be in force <br /> immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />Approved: _ <br /> <br />Cie=J< <br /> <br />Mayor <br /> <br /> <br />
