SECTION 731.04 PER>lIT FOR UI,Db. ICROUND CONSTRUCTION <br /> <br />In addition to the method of £nstallation described in Section 3 of this ordinance, <br />the applicant for a permit to be issued by the Council may use any method of under- <br />ground construction approved by the Public Utilities Commission of Ohio or the <br />National Electric Code, with or without lead covered cfible and to a depth under- <br />ground approved by such authority. <br /> <br />SECTION 731.05 USE OF POLE LINE BY CITY <br /> <br />Ail applications for permits to erect poles in the streets and alleys of the City of <br />Lakewood shall provide that the City may use the poles to be so erected and attach <br />thereto the necessary crossarms, wires or other electrical appliances as may be <br />deemed necessary for the police and fire signal service of the City and no permit <br />shall be issued by the Director of Public Works for the erection of such poles in <br />which application and permit does not provide for the privileges required by the <br />City, as herein contained. <br /> <br /> SECTION 731.06 SUBWAYS UNDERGROUND ~ORK <br /> <br />No person, firm or corporation, shall lay or construct or cause to be laid or <br />constructed any subways, conduits, ducts or pipes in the streets, avenues or <br />alleys within the City of Lakewood without first having obtained a permit therefor <br />under ~ valid and existing ordinance from the Director of Public Works. <br /> <br />NO person, firm or corporation, shall lay or construct or Cause to be laid or <br />constructed any subways, conduits, ducts or pipes in any public grounds or in any <br />real property of the City of Lakewood, without first having obtained a permit <br />therefor under a valid and existing ordinance from the Director of Public Works. <br /> <br />Any company or individual so placing wires underground in any street, alley or <br />public ground of said City shall upon written notice from the proper authorities <br />of the City that a sewer or water main is to be repaired or'constructed in such <br />manner as will necessitate the moving or altering the same at his or its expense, <br />mo as to permit the constructing or repairing of t~e sewer or water main where <br />ordered, and should any such person or company fail to comply with such notice, <br />the conduit may be altered or moved by the City and the cost and expense thereof <br />recovered from said person or company. <br /> <br />SECTION 731.99 PENALTY <br /> <br />Whoever violates any of the provisions of this ordinance shall be guilty of a <br />misdemeanor, and upon conviction thereof shall be fined not less than $100.00 <br />nor more than $500.00 and imprisoned for not more than 60 days, or both. Each <br />day~- violation shall constitute a separate offense. <br /> <br />'Section 8. That this ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and providing it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />_ PreSiden~ <br /> Clerk <br /> Mayor <br /> <br /> <br />
