ORDINANCE NO. 34-71 BY: Messrs. Gaydos, Graber, Huffman, Usher, Ward AN EMERGENCY ORDINANCE authorizing and directing the Mayor of the City of Lakewood to enter into an Agreement for the establishment of a Regional Council of Governments. WHEREAS, Chapter 167 of the Ohio Revised Code, provides that governing bodies of two or more Municipal Corporations or other political subdivisions may enter into an Agreement with each other for the establishment of a regional council consisting of such subdivisions, which Council shall have the powers and duties a:~ set forth in said Chapter, and WHEREAS, This Council hereby determines that the public peace, health, safety and welfare of the City of Lakewood and its inhabitants will be thereby promoted and preserved by membership of the City in a Regional Council of Govern- ments consisting of municipalities of Cuyahoga County and in the counties ad- jacent thereto established pursuant to Chapter 167 of the Ohio Reviewed Code, and WHEREAS, The purpose of the proposed Council of Governments is to foster cooperation between municipalities through sharing of facilities for their co~on benefit, including the establishment of a central collection facility for the purpose of administering the income tax laws of the various municipal corporations which are party to said Agreement and for the purpose of collecting income taxes on behalf of each such municipal corporation,and WHEREAS, The Agreement for a central collection agency with the City of Cleveland will te~'minate on December 31, 1971 and this City desires to join with other cities and villages in the establishment of a central facility for the administration of the municip~l income tax laws of the v~rious municipalities, to be operated by such Council of Governments, and WHEREAS, This ordinance constitutes an em&~gency measure for the immed~ te preservation of the public peace, health, and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, CUYAHOGA COUNTY, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to execute a membership agreement of the Regional Council of Governments in the form and content presented to this Council, attached to this ordinance-, made a part hereof and marked "Exhibit A." Section 2. That the Council of the City of Lakewood declares its intent to participate with~e other municipalities which are members of the Regional Council of Governments in the Municipal Tax Collection Agency, and to share the costs thereof, in the manner set forth in the Agreement for establishment of the Regional Council of Governments, and upon said Council being duly established, does hereby approve and authorize the powers and functions of the Board of Trustees of the Municipal Fax Collection Agency as set forth in said Agraement. Section 3. That Robert Mo Lawther, the Mayor of this City and R. N. Heege, the Finance Director of this City, are hereby approved as delegate and alternate respectively of this City to the Regional Council of Governments and they are hereby directed to report to this Council and keep it informed as to the programs, functions and activities 0f the Regional Council of Governments as they may affect or be of interest to this City and its inhabitants. Section 4. That the Clerk of Council is hereby directed 'to deliver a certified copy of this ordinance to the President of the Cuyahoga County Mayors and City blanagcrs Association to be subsequently deliw~red by him to the elected secretary of the Regional Council of Governments or other officer designated by it.
