C. Along a rear or side property line or portion of a rear or side <br />property line the following fences are permitted: <br /> <br /> 1. Fences not in excess of six (6) feet in height as measured <br />above the natural grade may be of any type. <br /> <br /> ~2. Fences in excess of six (6) feet in height measured above the <br />natural grade but less than eight (8) feet in height must be constructed so that at <br />least fifty (50) per cent of each lineal foot of said fence is open for through <br />passage of light and air° <br /> <br /> D. Between residential and nonresidential property, but subject to <br />the limitations of paragraph C, fence~ may be permitted ~long the property line <br />to the street line. Such fences may exceed eight (8) feet measured above the <br />natural grade and must be constituted so that <br /> <br /> 1. at least fifty (50) per Cent of each lineal foot of said <br />fence is open for through passage of light and air, and <br /> <br /> 2. must be located at least a distance equal to its height from <br />the nearest building which is used.in whole or in part as a place of human <br />habitation. <br /> <br /> E. Ail fences must be entirely on the owner's property. <br /> <br />F. No electrified fences shall be permitled anywhere in the City. <br /> <br /> G. Barbed wire fences are precluded lin residential areas, and are <br />permitted elsewhere only if they are fabricated of chain link topped with barb <br />arms o <br /> <br /> H. Enclosures for swimming pools shall be regulated as provided in <br />Section 1721.13 of the Sanitary Code of the Codified Ordinances of the City of <br />Lakewood. <br /> <br /> I. Ail fences shall be maintained in good condition so as not to <br />become unsightly, unsafe, a'nuisance, or detrimental to the surrounding area. <br /> <br />1319.98 CONFLICTING PROVISIONS <br /> <br /> Ail ordinances or parts of ordinances inconsistent with this chapter <br />are hereby repealed. <br /> <br />1319.99 PENALTY <br /> <br /> Any person' violating any provision of this chapter shall be guilty of <br />a misdemeanor, and upon conviction thereof shall be fined not more than fifty <br />dollars ($50.00). Every day of viol'ation shall be considered as a separate offense. <br /> <br />Section 2. That this ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the affirma- <br />tive vote of two-thirds of allmembers elected to Council, it shall take effect and <br />be in force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />Approved:, <br /> <br />Clerk <br /> <br />Mayor <br /> <br /> <br />
