ORDINANCE NO. 36-71 BY: Messrs. Huffman, Usher, Ward, <br /> Gaydos,: Graber <br /> AN EMERGENCY ORDINANCE to e~nact new Section 137.10 <br />of the Administrative Code of the Codified Ordinances of the City <br />of Lakewood establishing Fire Department record service charges. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the i~mmediate preservation of the public health and <br />safety and for the usual 'daily operation of a' municipal' department, <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Administrative Code of the Codified <br />Ordinances of the City of Lakewood be and the same is hereby sup- <br />plemented by enacting new Section 137.10 to'read as follows: <br /> <br />137.~.0 FIRE DEPARTMENT RECORD SERVICE CHARGES. <br /> <br />(a) The Director of Public Safety, through the record <br />department of the Division of Fire is hereby authorized <br />to make and collect the hereinafter provided charges for <br />the following service: <br /> (1) for copy of fire reports ....... $1.00 per side <br /> or any portion <br /> thereof. <br /> (2) photographs ......... , .......... $2.00 for each photo- <br /> graph. <br /> <br />(b) No reports o~ records referring to damage done by <br />or to the City, or by or to its fire fighters, shall be <br />furnished to anyone other than to the Law Department of <br />the City. <br /> <br />(c) Except in cases referring to fire damage done by or <br />to the City, or by or to :i.'t.s fire fighters, the above <br />services shall, upon prepayment of the fee aforesaid, be <br />available to: <br /> (1) Ail principals involved; <br /> (2) Bona fide representatives of such persons <br /> involved; <br /> (3) Attorneys repres i~nting any persons involved; <br /> (4) Insurance representatives whose companies have <br /> a perso~al interest in any of the parties by <br /> having some person involved in the fire insured <br /> with that company. <br /> (d) The Director of Public Safety shall establi~i~ <br />appropriate rules for the issuance of such copies. <br /> <br />(e) Ail fees collected shall be paid to the Director of <br />Finance at the end ~f eacl~ calendar month. <br /> <br /> Section 2. That this ordinance is hereby declared to be <br />an emergency measure for the reasons stashed in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force ira:mediately <br />upon its adoption and approval by the Mayor. <br /> <br />Adopted: ~/~:[ ~z_ /z/,/~'f]/ " <br /> <br /> <br />
