(g) <br /> <br />(h) <br /> <br />· <br /> <br />Maximum heigh__t - No part of a roof on any structure shall ex- <br />ceed three stories or thirty-five (35) feet in height above <br />the finished grade in front of and to the rear of each structure. <br /> <br />Parking requirement - Each dwelling Unit shall have an attached <br />garage not less than 10 x 20 feet dimension and there shall be <br />an additional one-half parking space for each dwelling unit in <br />the development. No part of the eighteen (18) feet width of an <br />acces's lane shall be used t_o. c_alculate required Pa.rking space. <br /> <br />~rou_ps of dwellings_- There shall be no more than ten (10) at- <br />tached dwellings in a group of dwelling units and no more than <br />four (4) dwellings in a group of dwelling units shall have the <br />same foundation line or roof line. <br /> <br /> Ownership reguirement - Proper provisions shall be made for the <br /> ownership of all the land in a Townhouse Development to be in <br /> the name of the owner until such time as fifty-five per cent· <br /> (55%) of the number of the dwellings have been sold to permit <br /> the formation of a unit owner's association in accordance with <br /> the provisions of Section 5311.08 et seq.~ R.C. After the form- <br /> ation of the owner's association the title to all said land <br /> shall be transferred to such association. The deed transferring <br /> title to such owner's association and every subsequent deed to <br /> unit owners shall contain covenants, conditions and restrictions <br /> requiring such owner, their tenants and all persons lawfully in <br /> .possession of the condominium property to comply with the pro- <br /> visions of this Chapter 12 and the declaratioq, byrlaws of the <br /> unit owner's association and administrative rules, regulations <br /> adopted pursuant to the provisions thereof as any of the same <br /> may be lawfully s~ended from time uo time. Violations thereof <br /> sh~ll be grounds for action for injunction relief or such other <br /> relief that may be available to the City. <br />(k) Sewer and water lines beyond the curb shall be installed by the <br /> developer and maintained by uhe association with Separate water <br /> meters installed in each dwelling unit. <br /> <br />(1) <br /> <br />The unit owner's association for and in behalf of its members <br />shall indemnify and hold the City of Lakewood harmless for any <br />damage to the private drive which may at any future time be <br />caused-by city vehicles, or other equipment using said drive to <br />provide municipal.services at the request of the property owners <br />or their association. <br /> <br />The construction of all the dwelling in a Townhouse project <br />shall be performed pursuant to one building permit (to ensure <br />the completion of all the dwellings within a reasonable period <br />of time). To secure these ends no building permit shall be <br />issued until the Planning Commission shall approve the plot <br />plan for the proposed development. Such plans shall be in form <br />satisfactory to the Planning Commission and shall include the <br />location and size of the dwellings and their relationship to <br />other dwellings or structures on adjoining lots. The plan shall <br />.also show points of access from adjoining streets and provisions <br />for visitor parking as well as landscape treatment indicating <br />the type, size and location of trees, shrubs and other land- <br />scaping. In making its determination, the Planning Commission <br />shall require conformance to the provisions of this ordinance <br />and in addition thereto may prescribe such other conditions <br /> <br /> <br />
