ORDINANCE NO. 6-72. BY: Messrs. Usher, Wendling, <br /> Brockman, Graber, Kelley, <br /> Magnotto, McBride <br /> AN EMERGENCY ORDINANCE providing for the sale of certain real property <br />located to the rear of an existing two story brick building known as the Douglas <br />Building, said building being located at the southeast corner of Detroit Avenue and <br />St. Charles Avenue in the City of Lakewood, Ohio. <br /> WHEREAS, the said real property (hereinafter described in the body of the <br />agreement) owned by the City of Lakewood, is no longer needed for any municipal purpose, <br />and, <br /> WHEREAS, for the foregoing reason, it is in the best interest of the City of <br />Lakewood that said real property be sold, and, <br /> WHEREAS, the Board of Control of the City of Lakewood has direcged that <br />~aid real property be sold, and, <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />;he immediate preservation of the public health, safety and welfare and for the usual <br />daily operation of a municipal department, now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OE THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. It is hereby determined 'that the real property described in the <br /> agreement set forth herein is no longer needed for municipal purposes. <br /> Section 2. This Council hereby authorizes the sale of said land to Douglas <br /> Industries, Inc., an Ohio corporation, and the Mayor is aUthorized a~d directed to <br /> execute, on behalf of the City of Lakewood, a contract for the sale of said property, <br /> · in substantially the following form: <br /> <br /> AGREEMENT ' ' <br /> <br /> THIS AGREEMENT made and concluded at Lakewood, Ohio, this . day of <br /> __, 1972 by and between the City of Lak~wood, Ohio of .. <br /> '12650 Detroit Avenue, Lakewood, Ohio, hereinafter referred to as "VENDOR" <br /> and Douglas Industries, Inc., an Ohio corporation, hereinafter referred to <br /> as "VENDEE". <br /> <br />WITNESSETH THAT: <br /> <br />For and in consideration of the mutual promises and agreements of the <br />parties hereto as herein contained and other valuable considerations, the <br />receipt and sufficiency of which are hereby-acknowledged by each party, <br />the Parties hereto hereby agree as follows: <br />1. Vendor agrees to sell and convey to the Vendee and the Vendee agrees to <br />purchase and pay for'upon and under the terms, provisions and conditions <br />contained herein the following described premises: <br /> <br /> Situated in the City of Lakewood, County of Cuyahoga, State of Ohio, <br /> '·and known as being part of Original Rockport Township Section No. 22, <br /> and bounded and described as follows: <br /> Beginning at the southwesterly, corner of land conveyed to Harry E. <br /> Siegel and Joseph B. Bloomfield and also known as the Douglas Industries, <br /> Inc., an Ohio corporation, which point is also 189.96 feet from the <br /> southerly line of Detroit Avenue, 76 feet wide, measured along the <br /> easterly line of St. Charles Avenue, 60 feet wide, and recorded in <br /> Volume 12588, page 499 of Cuyahoga County Records. <br /> Thence easterly along the southerly line of said parcel a distance of <br /> about 22.83 feet to a point wi~ich is the prtncipal place of beginning. <br /> <br /> <br />
