ORDINANCE NO. 31-72 BY: Messrs. Graber, Kelley, Usher, <br /> Magnotto, McBride, Brockman <br /> <br /> AN~EMERGENCY ORDINANCE authorizing the Director of Public Works t° <br />advertise for bids for the sale of the municipal off-street parking lot located <br />north of Detroit Avenue between Belie Avenue and St. Charles Avenue in the City <br />of Lakewood, which property is now owned by the City of Lakewood, and determin- <br />ing that it is in the best interest of the City that said property be sold. <br /> <br /> WHEREAS, the aforementioned parking lot was constructed primarily to <br />serve the business block on Detroit Avenue between Belle Avenue and St. Charles <br />Avenue, and <br /> <br /> WHEREAS, the aforementioned entire business block has been purchased <br />by a corporate owner which has advised the City that it is evicting all of the <br />tenants of said business block as of May 1, 1972, ~hd <br /> <br /> WHEREAS, the aforementioned corporate owner intends to raze all <br />structures in'said block, and <br /> <br /> WHEREAS, these changes in circumstances indicate a desirability to sell <br />the aforementioned parking lot for commercial ~development, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure in that it <br />provides for the immediate preservation of the public health, safety and welfare <br />and for the usual daily operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council determines that the off-st~eet municipal <br />parking lot located north of Detroit Avenue between Belle Avenue and St. Charles <br />Avenue should be sold and that such sale is in the best interest of this City. <br /> <br /> Section 2. That this Council determines that the sale of the afore- <br />mentioned off-street municipal parking lot will further the interests of this <br />City and it~ residents~ <br /> <br /> Section 3. That the Director of Public Works is hereby authorized to <br />advertise for bids for the sale of the off-street municipal parking lot located <br />north of Detroit Avenue between Belle Avenue anti St. Charles Avenue and further <br />designated as Permanent Parcel Nos. 312-t7-106 and 136 respectively. <br /> <br /> Section 4o That said advertisement shall state that any contract for <br />the sale of said property shall be subject to the approval of Council; that the <br />conveyance will be by the usual form of warranty deed used by the City and shall <br />be subject to taxes and assessments, both general and special, if any, all of <br />which shall be prorated as of the da~~ of filing the date for record and subject <br />to restrictions, conditions and reservations of record and zoning ordinances; <br />that the City will furnish the purchaser a title guarantee guaranteeing a good <br />and marketable title; that the escrow fee shall be paid one-half by the City <br />and one-half by the purchaser; that each bid shall include plans and specifica- <br />tions of commercial development of said property in conformance with the Zoning <br />~ode and Building Code of the City of Lakewood; that each bidder shall submit <br />proof satisfactory to the Director of Public Works that said bidder is prepared <br />to begin construction within 120 days from the date of the filing of the deed <br />for record; that the minimum bid shall be $120,000.00 and that the City reserves <br />the right to reject any and all bids or any parts thereof. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br /> <br />Adopted: c~). /~ 7~/ <br /> <br /> <br />
