ORDINANCE NO. 32-72 BY: Messrs. Graber, Kelley, <br /> Magnotto, McBride, Usher, <br /> Brockman <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor for and <br />on behalf of the City of Lakewood to enter into an agreement with The Congregation <br />of the Sisters of Charity of St. Augustine for the use by the City of Lakewood of <br />part of the Congregations property for the purpose of dumping fill material. <br /> <br /> WHEREAS, the City is desirous of obtaining an additional site for the <br />purpose of dumping fill material, and <br /> <br /> WHEREAS, The Congregation of the Sisters of Charity of St. Augustine, <br />the owner of property located at 14808 Lake Avenue~ Lakewood, Ohio, is desirous <br />of improving and protecting its property from eros'ion at the northern boundary <br />thereof adjacent to Lake Erie, and <br /> <br />and <br /> <br />WHEREAS, the City is willing to provide fill material for such purpose, <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />for and on behalf of the City of Lakewood to enter iuto an agreement with The <br />Congregation of the Sisters of Charity of St. Augustine, which agreement shall be <br />substantially as set forth in Exhibit A attached hereto and made a part hereof. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble, hereof, and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br /> <br />Mayor. <br /> <br />Adopted: <br /> <br /> <br />
