<br /> ORDINANCE NO. 34-72 BY: Messrs. Brockman, Graber, Kelle

<br /> Wendling
<br /> AN ORDINANCE granting to Cleveland Area TV, Inc., an Ohio corporation, the
<br />non-exclusive right to erect, maintain, and operate in, under, above, along, across,
<br />and upon the streets, lanes, avenues, sidewalks, alleys, bridges, and highways, and
<br />other public places in the City of Lakewood, Ohio, and subsequent additions thereto,
<br />for the purpose of transmission and distribution of television signals to enable sale
<br />of their service to the inhabitants of said City, and other purposes, for a period of
<br />fifteen (15) years, and regulating the same.
<br />
<br /> WHEREAS, An application has been received from Cleveland Area TV, Inc., an
<br />Ohio corporation, for permission to engage in a community antenna television system
<br />im the City of Lakewood, and,
<br />
<br /> WHEREAS, Said applicant must, of necessity, use the streets and highways
<br />of the City of Lakewood for the purpose of installing their systems, and,
<br />
<br /> WHEREAS, It is necassary that some regulation over said installation be
<br />promulgated, now, therefore,
<br />
<br />BE IT ORDAINED BY THE COLrNCIL OF THE CITY' OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. In consideration of the faithful performance and observance of
<br />the conditions and reservations hereinafter specified, the non-exclusive right is
<br />hereby granted to Cleveland Area TV, Inc., a corporation organized under t.he laws of
<br />the State of Ohio, its successors or assigns (hereinafter referred to as "The Company"),
<br />to erect, maintain, operate and utilize television transmission and distribution
<br />facilities, and additions thereto in, under, above, along, across, and upon the streets,
<br />lanes, avenues, sidewalks, alleys, bridges and other public places in the City of
<br />Lakewood and subsequent additions thereto, for the purpose of transmission and dis-
<br />tribution of audio and visual impulses and televisions energy in accordance with the
<br />laws and regulations of the United States of America and the State of Ohio, and the
<br />ordinances and regulations of the City of Lakewood, for a period of fifteen (15)
<br />years.
<br />
<br /> Section 2. Wherever used in this ordinance, the word "Television" shall
<br />mean a system for transmission of audio signals and/or visual images or any other
<br />type of closed circuit transmission and/or signal transmission by means of electrical
<br />impulses.
<br />
<br /> Section 3. It is contemplated that the Company will make arrangements with
<br />the Ohio Bell Telephone Company, The Cleveland Electzic Illuminating Company, or ~ny
<br />other holder of licenses or franchises from the City for the purpose of using the
<br />towers, poles, and attachments thereto of said companies for the attachment of tele-
<br />vision transmission and distribution facilities, subject to all existing and future
<br />ordinances of the City.
<br />
<br /> Section 4. The Company will not erect a separate system of poles in the
<br />City or on any street therein, but may erect poles where shown to be necessary when
<br />the necessity, the location, and the style of poles have' been approved by the Director
<br />of Public Works and the Mayor of the City, which approval will notbe unreasonably
<br />withheld. The erection of poles shall be subject to all existing and future ordinances
<br />and regulations of the City applicable thereto and under the supervision of the
<br />Director of Public Works
