Please substitute for ord£nance <br />distributed with docket <br /> <br /> OP. DINANCE NO. 2-73 BY: Messrs. Brockman, Graber, <br /> Magnotto, McBride, Usher, <br /> Wendling, Werner <br /> AN EMERGENCY ORDINANCE to supplement Section 351.01 of the Traffic <br />Code of the Codified Ordinances of the City of Lakewood by enacting a new sub- <br />paragraph (r) to said section to prohibit parking in a municipal parking garage <br />or on other public property where signs prohibit same or in any area other than <br />entirely within the individual parking spaces designated for the parking of <br />vehicles, and to supplement Section 303.08 of the Traffic Code of the Codified <br />Ordinances of the City'of Lakewood by enacting a new subparagraph (j) to said <br />section to provide for the removal and impounding of Vehicles parked in violation <br />of Section 351.01 (r) of the Codified Ordinances of the City of Lakewood. <br /> <br /> WHEREAS, the parking of motor vehicles on public property and in the <br />hospital garage particularly, in areas other than those designated for the parking <br />of vehicles is becoming more and more prevalent, and <br /> <br /> W~EREAS, such parking of vehic'le~ impedes the free flow of traffic therein <br />and constitutes a hazard to other users of s~fd facilities in the increased possibilit <br />of injury and property damage, and <br /> <br /> WHEREAS, such parking of vehicles constitutes an obstruction to or inter- <br />ference with the operation of equipment or the removal of motor vehicles in the <br />event of fire or otheremergencies, and <br /> <br />. WHEREAS, it would be in the best interest of the City to prohibit such <br /> Parking immediately,-and to. provide for the removal and impounding of such parked <br /> vehicles, and ' .., : <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br /> the immediate preservation of the public health, safety and welfare and' for the <br /> usual daily operation of a municipal department, now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD~ 'STATE OF OHIO: <br /> <br /> Section 1. ' That Section 351.01 of the Traffic Code of the Codified <br /> Ordinances of the City of Lakewood be and the same is hereby supplemented by enacting <br /> a new paragraph (r) to said section, said subparagraph to read as follows: <br /> <br />351.01 LIMITATIONS ON PARKING. <br /> <br />~o person Shall stand or park a vehicle except when necessary to avoid <br />conflict with other traffic or with the provisions of.this Traffic <br />Code, or in comPliance with the directions of a police officer or a <br />traffic control device, in any of the following places: <br /> <br />(r) <br /> <br />At any place in a municipal parking garage or on other public <br />property, excluding dedicated streets and ways set out for public <br />travel and herein regulated, where signs prohibit stopping, standing, <br />or parking, or in any areas other than entirely within the individual <br />parking spaces designated and marked off for the parking of vehicles. <br /> <br /> Section 2. That Section 303.08 of the-Traffic Code of the Codified <br />Ordinances of the City of Lakewood be and the same is hereby supplemented by enacting <br />a new subparagraph (j) to said section, said subparagraph (j) to read as follows: <br /> <br /> 303.08 ~MPOUNDING OF VEHICLES; REDEMPT%ON. <br /> <br /> Police officers are authorized to provide for the removal and impounding <br /> of a vehicle under the following circumstances: <br /> <br /> (]) When any vehicle ts standing or parked in a municipal parking garage <br /> or on other public property in violation of Section 351.01 (r) of <br /> th~Traffic Code. <br /> <br /> <br />
