I1TOENTURE OF LEASE <br /> <br />THIS INDENTURE OF LEASE, made and entered into at Lakewood, Ohio, this /~r~ <br />day of //~/~4/~ , 1973 by and between the CITY OF LAKEWOOD, whose <br />mailing address is 12650 Detroit Avenue, Lakewood, Ohio, hereinafter called <br />"Lessor", and MARWOOD, INC., an Ohio corporation, whose mailing address is <br />14700 Detroit Avenue, Lakewood, Ohio 44107, hereinafter called "Lessee"; <br /> <br />W I T N E S S E T H: <br />1. Premises. Lessor does hereby let and lease unto Lessee the premises ' <br />(hereinafter referred to as the "Premises") described as follows: <br /> Situated in the City of Lakewood, County of Cuyahoga, State of Ohio, <br /> being part of original Rockport Township, Section No. 22, and further , <br /> described as follows: , <br /> <br /> Beginning at the north easterly corner of property deeded to the <br /> Warren-St. Charles Company by deed dated March 20, 1959, and recorded <br /> in Volume 9484, Page 296, of Cuyahoga County Deed Records, which point , <br /> is in the westerly line of St. Charles Avenue distant 5.89° 15.50" West 25 <br /> feet from a point in the center line thereof, which is distant North O° <br /> said center line 349.18 feet from a monument marking <br /> 25' <br /> 43" <br /> West <br /> along <br /> a point of curve which is about 265 feet northerly from the center line <br /> of Franklin Avenue; <br /> <br /> Thence, from said place of beginning South 89° 15' 50" West along the <br /> northerly line of land so deeded to Warren-St. Charles Company 149.80 <br /> feet; <br /> <br /> Thence, North 3° 07' 50" East, 220.95 feet to the southerly line of <br /> land deeded to the Cleveland Land and Securities Company on August 31, <br /> 1954 and recorded in Volume 8088, Page 156 of the Cuyahoga County Deed <br /> Records; <br /> <br /> Thence, North 89° 15' 50" East along said southerly line 135.82 feet <br /> to the westerly line of St. Charles Avenue; <br /> <br /> Thence, South 0° 28' 43" East along the said westerly line of St. <br /> Charles Avenue 220.42 feet to the place of beginning. <br /> <br /> 2. Use. Lessee shall use the Premises for the parking of motor vehicles <br /> and for 'no other purpose except that the Lessee shall have the right to make <br /> such improvements to the building on said premises as may be necessary or <br /> incidental to parking purposes so long as the same shall not reduce below <br /> fifty-five (55) parking spaces the area available for such parking. <br /> 3. Term. To have and to hold unto Lessee for a term of fifty (50) years <br /> commencing on the first day of March, 1973 and ending on the 28th day of <br /> February, 2023, upon the covenants and agreements herein set forth. <br /> 4. Rent. Lessee hereby covenants and agrees to pay to Lessor, without demand, <br /> at Lessors office at 12650 Detroit Avenue, Lakewood, Ohio or at such other <br /> place as Lessor may from time to time hereafter designate, as rent for the <br /> premises during the continuance of this lease in accordance with the <br />I~ following schedule: <br /> <br /> <br />
