AN EblERGENCY ORDINANCE to appropriate property at and known as being 1354 Belle Avenue, Lakewood, Ohio. I~IEREAS, on the 20th day of November, 1972, the Council of the City of Lakewood adopted Resolution No. 4909, declaring the necessity and intention of appropriating the land hereinafter described, notice of the adoption of which resolution has been served on the owners, persons in possession or having an interest of record in said land, and, WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, ~erefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the fee simple in and ~o the following.described real estate be and the same is hereby appropriated for the purpose of construction of a multi-level municipal parking garage facility for the City of Lakewood, Ohio. Situation in the City of Lake~ood, County of Cuyahoga and State of Ohio, and Known as being Sublot No. 374 in. the Lakewood Realty Company's Subdivision of part of Original Rockport Township Section No. 22, as shown by the recorded plat in Volume 25 of Maps, page 26 of Cuyahoga County Records and being 40 feet front on the Westerly sid~ of Belle Avenue, and extending back of equal width 130 feet, as appears by said plat, be the same more or less, but subject to all legal highways. Section 2. That the Director of Law be and he is hereby authorized and directed to apply to the court of competent jurisdiction to have a jury impanelled to make inquiry into and assess the compensation to be paid for the fee simple interest in said property. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons set forth in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the ~yor ....
