ORDINANCE NO. 45-73 BY: Messrs. Magnotto, McBride, Usher, <br /> WErner, Brockman <br /> <br /> AN EMERGENCY ORDINANCE providing for the sale of the interest in real <br />property consisting of a two-family dwelling house situated on a parcel of land <br />known for street numbering purposes as 1343-45 St. Charles Avenue, Lakewood, Ohio. <br /> WHEREAS, the City of Lakewood is the owner of an interest in real <br />property consisting of a two-family dwelling house situated on a parcel of land <br />known for street numbering purposes as 1343-45 Sto Charles Avenue, having purchased <br />said property in conjunction with the construction of a multi-level municipal parking <br />garage, and <br /> WHEREAS, John S. Underwood of 1339 Belle Avenue, Lakewood, Ohio has <br /> offered to purchase said dwelling house for the sum of Twenty Five Hundred Dollars <br /> ($2,500.00) cash, and <br /> WHEREAS, this Council determines that said dwelling house is not needed <br /> for any municipal purpose and further that the sale of said dwelling house is in <br /> the best interest of the City of Lakewood and will further the interests of the <br /> City and its residents for the reason that said'dwelling w6uld remain on the tax <br /> duplicate of the City, and <br /> WHEREAS, this Council determines that said dwelling house should be sold <br /> at private sale as hereinafter specified for the reason that said dwelling house is <br /> to be placed upon property adjacent to 1339 Belle Avenue and therefore moved to that <br /> nearby locati°n at a minimum inconvenience to the residents of the City, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br /> the usual daily operation of a municipal department and for the further reason that <br /> said dwelling house should be sold immediately because of the vandalism currently <br /> going on in the immediate' neighborhood and the ~obability of imminent destruction or <br /> damage to said dwelling house if same is not disposed of forthwith, now,'theref°re, <br /> BEiT·ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1o This Council hereby authorizes the private sale of the City's <br /> interest in real property consisting of a dwelling house situated on a parcel of land <br /> known for street numbering purposes as 1343-45 St° Charles Avenue, Lakewood, Ohio <br /> and the Mayor be and he is hereby authorized and directed to execute on behalf of the <br /> City of Lakewood a contract for the sale of said two-family dwelling house to <br /> John S. Underwood, 1339 Belle Avenue, Lakewood, Ohio for the sum of Twenty Five <br /> Hundred Dollars ($2,500.00) cash. <br /> Section 2, That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives the <br /> affirmative vote of two-thirds of all members elected to Council, it shall take <br /> effect and be in force immediately upon its adoption ~dt approva~ by the ~ayor. <br /> <br /> -- ,.
